I want to file criminal complaint in court against the tenants for blackmailing, extortion in collusion with police officials. The tenants filed false complaints against me and vacated the property after extracting money from me, in collusion with police as police Sub Inspector pressurized to file FIR against me. The tenants withdrew police complaint after illegal extracting money from me. The husband and wife were staying in the property ,who made police complaint. The female tenants were also staying as paying guests in this property in Chandigarh and if I take any legal action, the husband wife duo would also try to get false police complaint of sexual harassment or theft of belongings from these tenants., filed against me, as they have previously tried to do so. All these tenants have vacated 6 months ago and this incident is 6 months old. As per the facts of criminal complaint ,I will have to dIsclose in my complaint the name of particular Sub Inspector , If I file criminal complaint against the tenants [the husband wife duo], then I have fear that police may victimize me by trying to implead me in any other false case or harass me in any other manner, what is the solution to prevent victimization by police?
- At that time itself you had option to reach out to SP office.
Complaint is already withdrew from them.
The contents of complaint are also have be looked into.
Do you have copy of the complaint. If not then get it through RTI.
- The money you had given is by cash or transfer.
- Its already 6 months and you are not able to forget it.
Even if you want to file complaint, do not put the thing 'collusion with police officials'.
What prevented you to remain silent for a [period of over six months without taking any legal action against the rogue police officer who helped the arrogant tenants who extorted money from you with the help of police.
You should have reported the matter to the higher police officer immediately when the incident took place and should have mentioned that you were threatened by the concerned police officer to implicate you in various false cases.
If you have evidences for this undesirable act of the said police officer and the tenant, you may submit a complaint against them to the top police officer of your city seeking proper legal action against them as per law.
1. You should not have caved in under pressure from police. You could have availed your remedies against police in the High Court.
2. Now that tenants have vacated and you have paid the money there is nothing you can do,
A criminal complaint against all these persons must be filed before a magistrate stating the issues involved. The police will not lodge an fir for obvious reasons.

1) You have the option to file complaint to police if they reject it , you have to by letter file complaint to police commissioner to order registration of FIR and if that too is rejected then you can make private complaint to the magistrate.
2) If the police and tenants are in collusion the police might not file compliant.
3) The undue delay on your part in filing police complaint will weaken case of prosecution when fir is registered. Make sure you keep all evidences of these illegal acts if you have them.

- You can file a compliant before the higher official of police after mentioning that under the pressure of the tenant and police official , you was forced to pay demanded amount by them as a condition to vacate the tenanted premises.
- However, as the said tenant was a female , then she can also lodge any false compliant against you with the connivance of that police official.
- Since you already got the possession , then don't wake up a buried person.

There's not a lot that can be done now as you have already withdrawn the cases without approaching the higher officials of the police or the magistrate. The tenants have also now vacated. So, it would be too late now and I would suggest for you to try and forget what you had to undergo and move on and avoid further unnecessary litigation as it can go either ways with the waiting time and the diligence being an issue for any further action to be taken from your end.
