• Eligibility of AP State Government Pension after changing the Citizenship

My mom retired from AP statement government as a teacher about 20 years ago and she is getting her Pension regularly. She also gets her husband's pension as well. She lives in USA as a permanent resident. I am thinking of applying for USA Citizenship and with this she would loose her Indian Passport and Indian Citizenship. If we did go with this possibility, does this affect pension income from AP state government? If yes, I need to know the proof with the actual Pension rules and what we can do avoid the loss of Pension.

Pension benefits are for the past services rendered by employee to Government to secure his/her standard of living after retirement in old age till death. Benefits go with person not with citizenship. Even after her naturalization as U.S. citizen she is entitled to her full pension as well as husband’s as if she is citizen of India.

Merely because your mother has taken citizenship of another country does not dis entitle her from taking pension from government of AP

Dear Sir/Ma'am,

A change of citizenship does not affect the pension in anyway. Your mother will still be getting the amount of pension she is entitled to. 

To continue receiving the pension every year, you need to appear at the office and provide a life certificate issued by an authorized official. 

You are also required to intimate the change of her nationality, along with nationality certificate granted by the country where the pensioner is residing to the Pension Disbursing Authority for the updating of records.

Your mother  will continue to get the pensionChanging her citizenship does not affect her rights and obligations in any way.

the pensioner/family pensioner will continue to get pension even if he/she becomes the citizen of another country because he/she get pension for the services rendered under the Government of India. Therefore, the change in the citizenship by any non-resident Indian pensioner will not affect his entitlement to the pension.

Your mother's pension would be given to her irrespective of her nationality. Nationality is not a criteria for grant of pension earned during service with the government.

-  As per law, changing of citizenship does not affect the right to get pension from the government job after retirement. 

- Hence, even after getting US citizenship, you mother is entitled to get pension income from state government. 

- However, for getting the pension , she should give her affidavit , and intimation letter of being US citizenship , to the concerned department.

Your mother will continue to get her pension irrespective of her nationality. She has to open an account in a PSB. She would have to inform the organisation about the change of her nationality.
