• Power of attorney with multiple agents

We are two brothers in our family. My father is getting old and forgetful and wants to give a POA to both of us to act on behalf for selling property in his name.

Can he give us a POA with both of us in it? We would prefer an option where both of us have to agree and sign off on any transaction. Is it possible to have such an option? Is it better to have a lawyer draft such a POA or a document writer in enough? This is in Guntur, Andhra Pradesh.

BTW we are both NRIs with US citizenship. Our father is an Indian citizen.

You should engage a lawyer to draft POA 

 

2)  Power-Of-Attorney must be executed in favour of single person/donee for single transaction it cannot be executed in favour of several persons for same act or single specific transaction.

There is nothing wrong in giving power of attorney deeds to multiple agents in the same deed.

an individual can select multiple attorneys and also decide whether they must act separately or jointly while taking a decision. 

Multiple attorneys actually help in making a sound decision by discussing all the advantages and impediments. However, in some cases, multiple attorneys can disagree on a matter which might delay an important decision.

There is no such provision in the law which prohibits the giving of power of attorney to two or more persons.

- However , he should mention in the said POA that any decision will be considered final only if the consent of both is involved.

- Better engage a lawyer for drafting .

1. Your father can execute a POA jointly authorising both of you to do and conduct the acts as to be prescribed by him.

 

2. It should be mentioned in the POA that the power is to be exercised jointly by both the brothers to make the act valid.
