• Buying agricultural land

I'm buying an agriculture land in Surehra, Delhi, which is a part of R Zone, the seller of the property has managed to get NOC of the land which comes under Delhi Master Plan. 
I came to know recently that mutation is not possible for time being. 
What would be your advice to someone who has already made a payment, what would be the challenges in Future or any advice to protect the ownership of land??
Please advise.

If the seller has not got it the agricultural land into NA, then with the NOC  you cannot get the mutation of property. 

You can apply for conversion with the SDM complying with the necessary formalities. 

After that you can get the property mutated to your name and also get house construction plan approved.

1. Check the NOC which must mentions the restrictions imposed by the government. 

2. If the construction is possible to be raised then eventually Mutation can be done. 

3. Send a RTI to the concerned department to know the present or future status of the Z zone property. 

4. To cancel the agreement refer to the sale agreement to fisuitable clauses.

Get the land bought to a farmer who must be you,your relatives or friends. 

When Government would relax and  start mutation process in future then complete the transaction and protect ownership.

Execute sales deed in favour of buyer and he can apply for mutation of property as soon as govt start the process of mutations.

- As per law, R Zone means residential zone land , hence before purchasing the said land you should be sure for the conversion of land into R Zone. 

- If that land not come under residential zone and is agriculture land , then legally you cannot construct there , and further it will not to convert the same into non agriculture land after apply before the competent authority.
