I have a farm house adjoining revenue road and on the other side of revenue road is an approved puda colony. I have purchased a plot in that colony for access to my farm house from main road Its( farm house - revenue road- my plot- main road) can i access my farm house from main road as the coloniser has not approved any boundry wall in his layout and he does not have any land in his possession to built boundry wall Also the colony is not closed colony ,
Yes. If there is no other way to access the property except traversing another's land and this has been going on for many years then you acquire easementary rights over another's land
Here from the pathway there is no other intervening land.
I'd that is so then you have no difficulty to access your property.
1) till compound wall is constructed by builder you can access your farm
house through Colony
2) if there is no other access you can claim easmentary right of necessity
You know that you cannot claim the road access by the suggested route as a right.
In that case do you want a legal validation for your proposed action.
1. You may create the access approach road thru your own acquired property.
2. However, IF a Society or Association is formed in future, THEN it would create problems in terms of building by the colony compound wall.
- As per the easement Act, you have your right to use the main road for approaching your land , and none having right to restrict for the same.
You can have a direct route to your farm house from main road. Even the builder cannot block the access to your farm house.
