• Copies of affidavits

1. I want to get a copy of affadavits submitted by UOI in CA No 3208/2015 UOI Vs Lt Col P k Chaudhary and Ors .I was not the party in the case but I am affected being in service
2. I had filied an RTI for the same but the Asst regsitrar has returned that since I am not a party of the case the copies cannot be given however he advised to file an application through filing counter as per provision of Supreme court of India Rules 2013 order XIII, Rule 2 read with order VIII, rule 6(1).
3. My queries are as follows:
 (a) Can I submit this application online through efiling at SCI website and if so then do I requires to submit any other documents or it has to be done physically at filing counter.
 (b) Any particular format of application ,if so then a copy can be provided
 (c) Can Supreme court reject my application on any ground
 (d) What will be the charges

1. One can apply for certified copy of the order from the court or Tribunal where it has been passed. 

2. He has rightly advised.  Even from the website you can get a soft copy. 

3. Since pdf file is available in the SC website you may not apply for its certified copy.

Yes you may file application online and payment may be also made online  

No specific format but all essential elements and details may be provided in your application for copy of Judgement and papers  

Yes SC may reject your application without assigning any reasons. 

Charges are applicable for ordinary and urgent copies INR 10 and 15 per page respectively. 

You may file an affidavit with your application assigning the reason for personal record  and for use in personal matter related to the case decided by  SC.

You need to apply in the court as per the SC order rules order XIII, Rule 2

 

And get copies from Registrar of the court and pay the copies fees accordingly to how many documents copy you want.

Application form to obtain certified copy available easily with the clerk.

Dear Sir/Madam,

It is suggested that it is suggested that online application are not required for the certified copy of the court documents. However, you may go the concerned counter and get the exact form, fill it up, submit the requisite court fee and other affidavit, then and there and apply the same at the designated counter. The court will allow the application and you will get the required documents.

Your online application may not be entertained by the registrar of supreme court, it may be rejected for want of many requirements becasue you are not even willing to take the assistance of a lawyer practicing in supreme court.

Therefore you may file a third party affidavit giving the clear and convincing reasons about the reasons for requiring the said documents and file a copy application along with a vakalat of an advocate of supreme court or without that also seeking certified copies of the desired documents before the registrar of supreme court in person..

You dont confused over the misleading opinions from various lawyers of this forum, you cannot get the affidavits from the website, they are not uploaded.

- Yes , the Asst . registrar is right to say that without being a party of that case , you are not entitled to get the copies 

 (a) Yes, you can submit online through e-filing at SCI website , as physical not started yet. 

 (b) You can take help from a lawyer for the same, otherwise you can move yourself , 

- If there will be descriptiveness in your application , then registrar will itself inform you through online mode. 

(c) Yes , there is possibility 

(d) You can get from website or with the help of lawyer to whom you will engage .
