• Eligibility for OBC certificate

My father started his career as Clerk in State Bank of India and retired As Chief Manager(Scale-4) in 2016. Mother is a 
housewife and our caste is listed as backward class. During retirement my Father's salary was more than 8 lakhs per annum. So now if I apply for OBC certificate m I eligible ??

What is your pension income of your father at present. If his last 3 year income whether pension or income from other secure is less than 8 lacs, you are OBC NC.

Check your parent's income for the last three consecutive years. If in any of the last 3 years it is below 8 lakhs, you are qualified for OBC Non-creamy layer status.

- Employees of banks are  not central government employees. They are governed by service regulations of their respective banks.

- Further, employees in Public Sector Undertakings, Banks, Insurance Organizations, who earn above 8 lakh per month are not eligible to get OBC-NCL certificate like a government employees. 

- Hence, if your father is getting more than 8 lakh , then you are not eligible to get a caste certificate of the non creamy layer.

No, you are not eligible for Non-creamy layer certificate since the annual income is above than the maximum limit i.e., 8 Lacs INR. The Eligibility criteria for getting reservation are :-

  • Parents are not directly recruited Class  1 (Group A) or Class2 (GroupB) officers OR they do not occupy any constitutional posts you are most likely to fall under Non-Creamy Layer OBC.

 

  • If your parents are not employed by the government, their income should be within the limits by the government to be treated as Non-Creamy Layer OBC.

Income criteria always base on other source of income not salaried and agriculture income.. 

you are eligible for reservation benefits. It is calculated on income not on pension.

The total annual income of your parents will be taken into account for the last 3 years on average basis  which should not exceed more than 8 lakhs then you are eligible for OBC otherwise No.

Since your father joined bank as class 3 employee and retired as class 1 officer you should be entitled to OBC NL certificate 

 

2) In August 2017, the Madras HC had ruled that if salary of parents employed in government is not a criteria for assessing “creamy layer”, the salary of a PSU employee “as a test  .. for identifying creamy layer brings in the element of hostile discrimination ..

If your father was promoted as class I officer after the age of 40 years then you become eligible to OBC NCL category.

Income more than 8 lakhs under this situation is not a legal impediment.

You should understand that the income last drawn during service will remain forever as the income of the individual to decide about the status, the pension will not determine the status.

  1. INCOME OF PERSON AND FAMILY COMBINED: A person can apply for an OBC certificate only if the annual income of the family is less than rupees eight lakh per annum. If it were more than the given figure, they would not be getting the non-creamy category certificate. (Income from agriculture/farming is not included in this)

  2. PARENTS EMPLOYED UNDER CENTRAL GOVERNMENT: If a person’s wither of the parents, is a part of central government or is working under Group C and Group D category under the central government, the person is eligible to apply for the non-creamy OBC certificate.

  3. EMPLOYEE UNDER CENTRAL GOVERNMENT: If a person himself or herself is a part of central government or is working under central government’s group B category, then that very person is eligible to apply for an OBC non-creamy layer certificate. It is to be noted that it is valid only if the person’s parents do not receive any income like that of pensions.

  4. HUSBAND EMPLOYED UNDER CENTRAL GOVERNMENT: If a women’s husband is employed under the Central Government, then that very woman would be eligible to apply for the certificate provided that her parents do not receive any kind of income.
