The brief facts are as under: Date of Registration: 23/01/2020 Date of Possession: 01/002/2020 Member of RWA Maintenance: All Maint. dues of the flat paid to the builder for the pre- possession period. Also no maint. dues outstanding as on date, Paid fully to RWA. Issue: The RWA has passed a Resolution banning entry pf all ftat owner's who have not taken an NOC from the RWA. The RWA was initially demanding Maint Dues of the prior period, latter on back tracked and refused to accept payment when we offered to pay them the amount, also they did not quantify the demand.Do the RWA have any authority to prevent the owner from living in the flat or banning the entry of the household goods. 1. No RWA restrict a flat owner in having peaceful enjoyment of the property including free ingress or egress into the respective flats even if there was maintenance charges were pending.
