• Transfer from Holding company to subsidiary

I joined in August 1980 in Holding company but got transferred on April 1, 1982 on promotion but had not resigned from Holding company.
Was in service in subsidiary company till May 2004 but resigned due to personal reasons when still 6 years of service was there as per appointment letter of Holding company.
I had received all terminal benefits from subsidiary company.
Will I get compensated for balance 6 years of service in subsidiary company?

When you resigned from your job then I wonder under what provision of law or logic you can claim benefits for the period you decided not to serve. 

Therefore I don't find any merit in your claim.

What is the basis for your demand for compensation for remaining six years of service when you have resigned voluntarily from the service. 

Have you taken VRS from the company which covers the remaining service by paying any compensation. 

If so, you first approach the company where you took VRS, if they disown the responsibility then you can plan further course of legal action.

Resignation withdraws all basic facilities,perks and remuneration from organizations as you are no more part of the organization. 

Therefore No benefits after resignation or VRS Scheme preferred from Holding or subsidiary company.

- As per your query , you was working in the Subsidiary company after getting promotion , without giving resignation in the Holding company . 

- As per law , you cannot work in two company ,and claim any benefit from the earlier company.

- Further , VRS applies to employees who have completed 10 years of service or are above the age of 40 years. It applies to workers, executives of companies and/or to an authority of a co-operative society.

-  Hence if you have taken VRS on the personal grounds , then you can claim compensation for balance 6 years from subsidiary company.
