• Being over-charged & threatened by exploitative forwarding company

Hi, I ordered a small telescope from AliExpress. The seller mentioned that they'll be using a shipping company called "Yitong Express" for delivering my package.

I received a call today from them, and they said that my package had arrived in India, and they quoted me a 80% customs duty on the package. On enquiring further details from them, an employee called Shameem threatened me saying that if I don't pay the amount, even my "father won't be able to find the package". I asked him to mind his language (albeit a bit rudely), to which he threatened me saying that he has my address and personal details, and that he can "finish me off".

On checking the ICE Gate website, I found that the customs duty in my case should've been 44%, and not 80%. On checking the forwarding company's google reviews, it seems like I am not the only one who has had problems - ALL reviews for them are 1 star reviews, and they are known to harass people.

Please kindly advise on what legal options do I have at this moment?

- You should lodge a compliant against the said official before the police for the offence of cheating, blackmailing and threatening , and further forward one copy of the same to the AliExpress.

- Legally, custom official never call to consumer , except send a notice.

- You can also lodge your complaint before the cyber cell as well.

You can claim your package legally. If the said company has any office in India you can file consumer complaint against them. Otherwise you can't do anything. You can claim your parcel from customs after paying duty

Since you know the name of the person who behaved with you in a rude manner, you first resort to legal action by issuing a legal notice to the company mentioning about the misbehavior of their staff over phone on so and so date.

You also make a mention that he has threatened you that he will kill you or words to that effect since he has your address. with him

You ask them to explain for having deployed such hooligans in their employment that whether to threaten the customer  or whether they are not law abiding citizens.

You can also mention that you will sue them for defamation as well as for criminal intimidation and threats  if they do not apologise  for this kind undesirable behavior with the customers.

You state that he was demanding excess charges towards customs duty whereas the actual customs duty was not even half the amount demanded by him, hence this is an act of extortion.

You can take the assistance of an advocate to issue this legal notice.

1. You should lodge FIR against that person for criminal breach of trust, criminal intimidation and charging you inappropriate custom duty.

2. You should record his call before lodging FIR against them.

3. You should also send a complaint to customs department against courier service.
