• Pay protection from central govt during probation technical resignation

I am working in 4600gp job presently. I got a job in 2800 gp. I want to resign due to family/work issues. It has been 7 months since i joined in my 4600gp job. I want to give technical resignation. Since I am going through proper channel, will I get pay protection in new job as per pay protection in 7th CPC order dated 5th Aug 2020.

Don`t think so. Pay protection on joining lower pay grade may not permitted. If any person apply for lower post then there is no provisions to protect the pay.

- As per rule, Pay protection is a way of safeguarding the pay. and conditions of service of employees whose pay is adversely affected by organisational change , it means to allow the individual to find another post at their original pay band or to adjust to the lower salary within the protection period.

- Further, when a government servant applies for in the same or another department through proper channel and on selection he is asked to resign the previous post for administrative reasons the resignation is called technical resignation.

-  Further , Protection of pay drawn in Pay Band against the post held in the previous organisation shall be admissible only to such direct recruits who had applied through proper channel for appointment to the post in this department after tendering technical resignation and were holding a post in the previous organisation either with same or lower grade pay

- Hence, as you are going through proper channel , then you will get pay protection in the new job under the term Technical resignation.

You should get pay protection if you submit technical resignation and go through proper channels

Yes you can claim pay protection but you may not get pay protection because you are resigning without completion of your probation period but you can still give it a try by making application before competent authority.
