You may get GPA executed to complete conveyance deed.It is valid. GPA must be registered with The Registrar of Assurance and sub-registrar office at New Delhi under whose jurisdiction your landed property is situated.

Every single original document from the origin of property will deliver to buyer.

Sale deed will execute at sub registrar office. 5% stamp duty payable. Women  buyer gets 1% rebate otherwise it is 6% and this is very from state to state.

What this mean -

GPA and sales deed. I want to get the GPA to conveyance deed,

First of all check the mother deed and also see that the land is in the name of the seller in land records. The metes and bound shall be clearly mentioned as well as carefully go through the schedule.

Unless the GPA holder is close relative of the original owner such sale on its basis is without any force of law.

Without checking the the relevant papers its very difficult to advise on the clear title of the property.

Get the past title deeds, mutation or Revenue records checked by an advocate.

GPA is a general power of attorney. The registered property owner (in whose name property is registered in government office records, generally the Registrar Office) can give a GPA execution in favour of his spouse, son, daughter, brother, sister or any other relative to manage his property.

- The following documents should be taken from the buyer at the time of purchasing the agriculture land.

1. Title deed of the Seller

2. Stamp duty Receipt i.e. government taxes paid on the land:

Stamp duties are government taxes and differ between states. A stamp duty paid is a legal instrument and can be accepted as proof in court.

3. Mother deed i.e. earlier owners documents

4. Encumbrance certificate for the last 13 or 30 years may be obtained from the office of the Sub-registrar to ensure that the land does not have legal obligations or complaints.

- Legally , a GPA holder is not authorise to sell and execute Sale deed , if the said GPA is given for transfer the property and not to a relative .

The GPA is not a title deed.

What do you men by converting the GPA to conveyance deed?

The GPA holder, if his principal is still alive, can execute a registered sale deed ion favor of the prospective buyer on behalf of the original owner, provided the life certificate of the principal is produced.

You consult an advocate in the local before doing anything in haste

The list of documents will depend on the nature of the property and the status of the property.

The list is exhaustive and would be based on the prevailing circumstances.

Hence you better approach an advocate in the local who will guide you properly about all the documents to be procured as well as he would be able to render a legal opinion with his recommendations to buy this property.

He would be able to guide you about the stamp duty, registration charges also for purchase of this property.

1. You need to pay stamp duty and registration charges for convering a GPA to conveyance deed which varies from state to state and area to area depends on circle rate.

2. You need to check that land is seld acquired or ancestral and if ancestral then all legal heirs are giving consent for selling the land or not.
