• Can a Pvt Ltd company buy agri land in Odisha?

I have a pvt ltd company with 4 directors. My company is allowed to do agriculture and related activity. We are looking at purchasing rainfed agricultural land in odisha. Can we purchase? Is there any limit on how much land we can purchase?

-  Yes, a pvt ltd company can buy agriculture land and can perform agriculture activities  with the approved provisions of articles of association and memorandum of companies.

- Further, there is no requirement of any director being an agriculturist . 

- Further, it should must be approved by the Registrar of Companies , like your which has already allowed to do agriculture and related activity .

- Only 12.5 acres agriculture land , a pvt. ltd company can purchase , and for purchasing more permission is required.

1) in Orissa person cannot own more than 10 acres  of land If family members are not more than 5 of class 1 land . If it is class 2 land then 15 acres , class 3  land 30 acres and class 4 land 45 acres 

 

2) company can buy land in excess of ceiling limit if it is used for non agricultural purposes . You should start your industrial unit within period of 5 years

4) you cannot buy land belonging to scheduled tribes

A Pvt. Ltd. company CAN CERTAINLY BUY AGRICULTURAL LAND and develop and perform agricultural activities on it, BUT SUBJECT TO the approved provisions of articles and the Memorandum of the pvt.ltd and MUST be approved by the Registrar of Companies (ROC). There is no requirement of any director being an agriculturist.

1. Yes you can purchase agricultural land in name of your company in Odisha.

2. There is no limit for purchase of agricultural land by a firm but you need to take permission from District collector before purchase of agricultural land.

You can purchase agricultural land in Odisha.

As per section 37 of Orrissa Land Reforms Act, 

Person: company, family, association or other body of individuals, any institution capable of owning or holding property;

10 standard acres per person • Family consisting of more than five members, the
ceiling shall be ten standard acres increased by 2 standard acres for each member in excess of 5, the total ceiling area shall not exceed 18 standard acres.
