• Fraud in TV recharge

Few days back my mother , recharged Airtel DTH TV by scanning QR code which appears on TV by Airtel , to directly recharge and we have been doing this since almost a year .But on 13th July by mistake she did recharge of Rs50320 instead of Rs 320. Money got debited from account against AIRTEL UPI .
On confirming and sharing transacational details AIRTEL denying any such payment made against payment reference details shared .Even i shared my bank account statment with them.

On confirming with HDFC bank , they informed payment succusfully done to beneficiary and asked to check with beneficiary to share there account details/bank statment for verification.

Airtel customer care is not resposnding to my mail when asked to share there account statment and just coming with reply to check with bank as they have not received payment .
Its just one party to another party transaction without any 3rd party involved still no tracking of money is being done . Also i recharged using same scan from TV after 2 days for Rs 360 and reharge happened succesfully .

Please give advice how to leagally proceed

- It is very ashamed that the officials of the AirTel type of company is playing fraud with the consumers after playing a short cut technique.

- Since, your bank has already confirmed the debited amount of  Rs50320 after crediting the account of AirTel , then the said company is bound to refund the extra amount with interest in your mothers account.

- If the customer care is not lodging your complaint and refunding the same , then you should send a legal notice to the AirTel , and thereby ask for compensation for mental harassment as well.

- If, no response then file a complaint before the Consumer court for getting full amount refund with compensation.

This is an out and out fraud for which it can be brought to judicial Review.

This act of the Airtel is cheating as well criminal breach of trust.

So lodge a complaint with police alleging the offence.  Once it's done FIR can be registered after which the company should come forward to settle the dispute with you.

Please make complaint in writing to cybersecurity cell in your area submitting all details along with bank details and statements of accounts for investigation against Airtel Co.

Cybersecurity cell would investigate and register crime under cyber crime I T Act 2000 with 420 I P C

They may recover your amount in excess paid to Airtel after registration of crime against them.

Bank has duly verified amount debited from your account to airtel. Send legal notice for immediate refund and if not refunded within 7 days. Have to file consumer complaint.

Dear Sir,

You are suggested to approach your HDFC bank once more and get the details of the bank account in which the amount was credited. The serve the legal notice to that AIRTEL and ask for refund of the money and if not done file the case for the same.

Police may not register FIR. But can try.

Not RBI but broadcasting ministry.

Actual releif will get from consumer court only.

First send legal notice, for that no need to go out. Contact an advocate.

RBI and  Cyber security cell has no connection with the dispute.

Criminal case is good option.  Else file civil suit.  Consumer case may not succeed.

You can issue a legal notice to the company demanding the return of the excess amount paid to them by mistake.

You can attach the documentary evidences to establish the fact in the legal notice.

If they don't respond or comply with the demand made you may file a money recovery suit on the same lines.

Consult a local advocate and proceed as suggested

You have to check in your airtel wallet if you can see the amount there well and fine and secondly, you can check amount by dialling 12150 from the registered number. If the payment is via airtel subsidy medium, the amount might be blocked at subsidy. You can go to nearest airtel customer center and request them for details. You might recive a message on your registered mobile number. In case of not receiving any message or response from customer care, you can proceed with legal case against them.

Dear Sir,

All above suggestions are correct and you are suggested to file complaint with RBI which will be online and you may not be required to go anywhere. The action of legal notice and other things may happen later also.
