Dear Sir, 

I am currently serving in armed forces and my basic salary is 71,000. I will retire with a basic pay of level 12A at an age of 39. I intend to clear UPSC CSE or BPSC PCS exam. I need to know that in that scenario, will I be able to enjoy pay protection as my previous salary be of level 12A (Plz tell in both cases, UPSC and BPSC)

Also, will I be able to get age relaxation on both ex-servicemen and OBC (keeping in mind the creamy 
layer). Discuss both, UPSC and BPSC

Yes,Definitely. 

Your protection would be considered on merits of your aggregate performance and post preferences. 

UPSC CSE and BPSC PCS exams are conducted by Central Government and State Government wherein the process and selection of candidates differ.

After retirement and then joining will not come under the pay protection framework. Being creamy layer you may not get age relaxation but being ex servicemen you can get such benefits

Age relaxation crietria is clearly mentioned in the application forms.

As far as salary is concerned you are talking about technical resignation which is when you join a job while serving in the previous one.

Here you will retire and then join. So no pay protection.

creamy layer bar of income is Rs.8.00 per annum(income of the family) and for the pay protection you are entitled for the same either of the department UPSC or BPSC.

Reemployed pensioners shall be allowed to drawn pay only in prescribed scales of pay for the posts in which they are reemployed. No protection of the scales of pay of the post held by them prior to retirement shall be given.

Ex-servicemen candidates who also fall under the SC/ST/OBC category are eligible for grant of cumulative age-relaxation under both the categories.

Dear Sir,

It is informed that as per the policy is vogue, the reservation of age (age relaxation) for defence personnel are applicable for lower cadre and not for UPSE CSE and BPSC PCS examination. However, it is also suggested that you will be eligible for BPSC PCS as per age criteria. Also, there is no specific law for pay protection in such jobs, but that requires a writ petition for review of policy on this matter.

When a Government servant applies for in the same or another department through proper channel and on selection he is asked to resign the previous post for administrative reasons the resignation is called as a technical resignation formally.

If you are retiring and taking up an employment in a government organisation or PSU, you will be eligible for the benefits available for ex-servicemen which will include pay protection and age relaxation.

However your past services may not be counted for the purposes of promotion or pension

- As per rule, Pay protection is a way of safeguarding the pay. and conditions of service of employees whose pay is adversely affected by organisational change , it means to allow the individual to find another post at their original pay band or to adjust to the lower salary within the protection period.

- Further, when a government servant applies for in the same or another department through proper channel and on selection he is asked to resign the previous post for administrative reasons the resignation is called technical resignation.

- Hence, if you will apply after the retirement , then it will not come under the term Technical resignation. 

- Further, there is no provision of pay protection in respect of Ex-Service man candidate in may organisations. 

- However, you are eligible for getting age relaxation in the two said commissions if you have completed of 15 years active service in the armed forces.

You will not get benefits of pay protection as you are going to join another job after retirement from previous employment.

You can claim age relaxation of ex servicemen and OBC as per notification of the job you are going to apply for.
