• Non-agriculture to agriculture (revoking), Andhra Pradesh

Hi All , I am from andhra pradesh . I own a property of 6.5 acres . I converted 6.5 acres agriculture land to non-agriculture land to setup small scale industry but due to financial crisis , i thought of selling the same land. Now as it is converted , no one is showing interest to buy as the land rate is 2.9 crores as per government but in real there price varies between 15 lakhs to 20 lakhs per acre . And stamp duty also very high . so is there any method of cancelling conversion order or any method of revoking into agriculture land . Thanks

Start fertilizing and cultivating crops on that agricultural land and show it the collector that its agricultural land then do perform all agro based business, like cattle farming, small nursery, boi-tech park, different types of seeds development which will produce more crops after cultivating etc. there are lakhs of project in farming co-business.

Dear Sir,

You are not taking wise decision. In this modern situation it is very difficult to to convert land from agriculture to non agriculture.

It is possible to convert non agriculture to agriculture through same Collector or Revenue Office as it is within powers.

You may get mortgage loan on the non agricultural land more and more and for the present you can use the same. In future you will get big prize for non agricultural land. Please take wise decision.

Yes you can simply apply for the cancellation of conversion, if that doesn't work than file suit for specific performance.

1. You may try to file application before the district Collector office, for your requirements, supported with all documentary evidences and request for revoking of earlier order of conversion.

2. Though the above is not easy, but you may make a try, with the help of a local Property Lawyer.

3. However, if will not be in your financial interest to convert it back to Agricultural land, since it is again going to cost you lots of time & money and difficulties in your income tax returns.

If the land is not used for the said non-agricultural purpose within 2 years than the conversion order shall be withdrawn. And land reconverted to agriculture.

OR apply for withdrawal of conversion order.

 some states have a provision that if the purpose for which the land was converted is not carried out in a certain period of time, the permission is cancelled and the land reverts back to agricultural.

- Since the said land already converted into the non agriculture land , hence you will have to apply before the office of Collector for reconverting the same into agriculture land. 

- But , the non agriculture land can be converted into the agriculture , if no development work is started therein . 

- Further, if you have not paid the conversion tax , non agriculture fee and taxes within 30 days of getting permission , then the land will convert into the non agriculture . 

- Further, if collector refuse the same , then you will have to take permission from the High court after filing a Writ petition .

In Karnataka state and some other states, if the converted property has not been utilised for the purpose it was converted within  stipulated time, then the authorities may pass an order to revoke the approval granted for conversion.  

You can check if there are any such provisions in your state with the collectorate in your district and proceed on the advise rendered by the land revenue department at the collectorate.
