• Khata transfer fees for property inherited through will. Only Bangalore

Dear Sir,

We 11 relatives inherited a landed property in Bangalore through a Will. The Will was written by our aunt, wife of our uncle (who was a blood relative). Though the uncle was a blood relative, the aunt is Not a blood relative. The property is not sold yet. We are planning to transfer the Khata from our dead aunt's name to our names. As per Karnataka Rules (may be BDA or BBMP) how much fees will be required to be paid for this transfer? Some people say, since the aunt is not our blood relatives, we have to pay the full fee (2% of stamp duty, the stamp duty being 5% of the govt. face value of the property). Some people say it is only a small fee, not the 2%. Which is correct? Bangalore property lawyers please answer.

Rs.250 to be paid for khata transfer in the event of death of the original owner. At the time of applying for khata transfer,the unpaid property tax till date is also to be paid at the rate of Rs.0.20/Sq.Ft/year for vacant land, Rs.1.20/Sq.Ft/year for self occupied building and for leased out buildings at Rs.2.40/Sq.Ft /Year. An additional of Rs.500 is to be paid, for private (non BDA) properties, as general khata transfer fee.

See for transfer of khata the fee applicable is nominal. You do not have to pay the stamp duty on this. You can apply for mutation of property based on the will.

Fee for Khata Registration is 2% administration fee on stamp paper value. Rs.100/- per sq.yard (in new areas) or Rs. 50/- per sq.yard (in old areas) towards improvement expense.Fee for Khata transfer or modification such as bifurcation or amalgamation is 2% administration fee on stamp paper value.

Stamp Fee to be paid is 2% of the Stamp Duty that you have paid at the time of your Sale Deed registration. So suppose you paid a Stamp Fee of around Rs. 5 lakhs at the time of registering your property, the Stamp Fee at the time of Khata transfer would be 2% of 5 lakhs i.e. Rs 10,000.

Mutuation requires negligible fees. If you want to execute any sale deed, gift deed or other documents then you require applicable stamp duty and registration.

No stamp duty payable on transfer of property in municipal records. Fixed transfer fees may charge only which is nominal.

Stamp duty is paid when transfer deed  (sale,gift deedetc) executes at sub registrar office.

See if you are not applying for probate just for mutation 2 percent fee is not applicable. In will there is no difference on fee payable.

1. Stamp duty or registration fees is not applicable for khata transfer when you get the property through Inheritance.

2. You have to pay fixed nominal charges for transfer of khata in records. It doesn't matter the property is inherited from blood relation or not.
