Can developer change cts no or subdivide a plot, when there is a building of which society is formed in 2013.afterwards without permission of society?

Builder is owner of land as no conveyance has been executed in favour of society 

 

builder can apply for sub division of plot without society consent 

 

if conveyance is executed in favour of society then society permission is necessary for sub division of plot

1. YES, the developer can change or subdivide the plot, PROVIDED the Society GB passes a resolution to that affect and Society signs as "Consenting & Confirming Parties" alongwith the developer in the relevant Deed & Documents.

2. Without above the Developer CANNOT do anything, whatsoever, AFTER the Society was registered. This has been upheld in several HC judgments.

Any such act carried out by the builder after the society is formed and handed over possession to the society especially after having obtained OC for the flats, shall be considered as an illegal act.

You can drag the builder to the court of law by terming such acts as illegal and cheating offence seeking releif and remedy for this
