Dear sir, we belongs to Kulalar community ( pottery, clay & paper toys manufacturers ) comes under MBC quota. We are situated in cuddalore, Tamil Nadu. Government has developed many area wise society for pottery & toys manufacturers. In our area, there is one society but it is not functional ( recently built, number - 1742). Since long time, we used to worship our community Goddess Sivakami in that place for our community & business development. Now we want to build one temple in that place. My question is * Can we able to purchase that land from government for our community goddess temple? * Is there any way to form one trust in the name of our community goddess and purchase that government land in the name of our trust? * what is the way forward to purchase land and build temple in that place?

1. The mentioned things can be done ONLY "AFTER" obtaining proper permission from the state Govt., and Regional Town planning dept., for construction of any structure.
2. ONLY a registered Trust /Society /NGO will be entitled to purchase /lease said Land, for the specific purposes.
Request the govt. to allot the land or sell on concession to build temple belongs to community. Land can be purchased in the name of trust or trust can be formed later and land gift to trust.
Above possible at request but not as a matter of right. If same area is used for worship from long time than can seek direction from court if govt. refuse.
You can approach the government to allot land temple.
Trust can be formed and registered with a minimum of 03 members and a maximum of 21 members.
1. Yes you can send a proposal for purchase of land for community purpose.
2. Yes a trust can be formed and purchase land for construction of temple.
3. If govt refuse the proposal then you can go ahead for purchase of private land and build temple.
Until and unless the property is in your possession and enjoyment for over 30 years it cannot be claimed even by adverse possession.
Forming a trust is your decision, you can form a trust in the name of your own community for private or public or religious purposes.
The trust cannot be restricted to buy the land out of its own fund for any purpose they would desire.
