• Builder delaying registry of Flat in Noida

Hello, We purchased a ready to move in flat in Noida Sector 77. Took a loan from PNB Housing for the same and all legal documents etc were clear. Since then, we recieved posession within 2 weeks - in July 2019. Stamp duty for the registry was also paid in July 2019. The builder has delayed the registry of the house until now - 31 Jan 2020 and always keeps saying it will be done next week, next month etc and says it's waiting at the Noida Authority. How can i speed up this - will doing a RERA complaint etc help? Thanks a lot!

You can first issue a legal notice to the builder if on notice he fails you can file a complaint before the RERA authority and seek compensation and direction for registration.

Complain to RERA and he only should be responsible for any penalty as sale deed must register within 4 months of sale. RERA has short span to decide case.

Last remedy, have to file suit under specific relief act to direct builder to register sale deed.

2. You can also compensation for delay in registration along with mandatory injunction for execution of registration of sales deed.

Approach UPRERA. Perhaps they haven't been granted the OC and CC and because of that they are unable to execute the sale deed. Act mandates that the dispute filed before RERA Authrotiy be resolved within 120 days.

First issue a legal notice to the builder instructing him to execute a registered sale deed  for the property on your name  immediately within 7 days from the date of receipt of this legal notice.

Failing to comply with the demand made, you may approach RERA with a complaint agaisnt the builder or to civil court with a suit for specific relief.

All the RERAs across the country have time bound actions.

In any case even if you do not want to fight  case for years, you have no alternative for this if you decide to take it up legally or you may wait for years till such time the builder shows mercy on you to execute the registered sale deed.
