• Covered car parking allotment

Sir, I have purchased one flat along with one covered car parking in Pune under construction from a well known builder. In sale agreement it is mentioned that the unit agreed to purchase is residential flat number xxx including one covered car parking. The project is MahaRERA registered. Now the builder is denying to give any documents for allotment of parking that which parking is allotted to me. Simply he is writing in possession letter that the possession of flat along with one covered car parking is given. But he doesn't mention parking number. My question is can I go to legal advisory body for justice

Issue legal notice to builder rectify sale  deed to mention sale of covered parking slot as full consideration for parking was made by you 

 

2) if he refuses file complaint against builder before RERA and seek orders to direct builder to execute sale deed for covered parking slot as full consideration has been paid by you

- As per law, A builder has to provide a certain number of parking spaces basis the number of units of houses, by way of allotment letter.

- Since, the builder denying to give any documents for allotment of parking , then firstly send a legal notice and thereby ask for allotment letter for cover parking.

- On, refusal ,you should lodge your complaint with MahaRERA for the same.

The builder have to give the no. of covered parking. Please note that the parking is not registered in sale deed but you have all the right to get possession of exact covered parking attached to your flat. For any dispute you may raise the issue with rera and claim compensation.

The covered parking as per the agreement has been provided by the builder in the deed, however you can come to know about the exact place of parking allotted to you at the time of handing over possession.

If you are aggrieved over it then you can drag him to consumer forum for deficiency in service should the allotment caused you grievance.

This is not proper procedure to acquire car parking. Purchase of covered parking with exact location will mention in sale deed and stamp duty payable than only perfect title on parking will transfer to you.

Complain to RERA if builder not agreeing.

what is the initial agreement with the builder and providing car parking facility is mentioned in the agreement he has to clearly demarcate for each flat . And if there is a violation on his part you can take action against the builder under rera or you can file complaint before Consumer forum.

1. No you cannot approach legal system to force builder to provide you particular car parking number.

2. As allotment of car parking by builder will become null and void after formation of society because it is a common area of society and only society association can allot parking space to residents.

You should give him a legal notice to specifically state as where is your parking space. If he does not respond then file a complaint in the district consumer forum.
