Hi, My father (born 1952) joined as Assistant Engineer in 1981 (Group 2/Group B) and got promoted to Executive Engineer (Group 1/Group A) after 40 years of age( year 2000). Today he is retired and having pension above 8 lakhs per annum. I want to know if i belong to OBC non creamy or OBC creamy layer so that i can make my certificate.

Direct appointment to class B and promoted to class A before 40 years if for privileged class. In this situation even when income is less than 8 lac, they(children) will consider creamy layer.
In your case only income criteria of parents will judge which is crossing income limit.
sir , As stated above in my query 1952 to 2000( promotion to Group A) is more than 40 years. I belong to " Chandravanshi community" ,certainly not the privileged class.
You belong to non creamy layer as your father was recruited as group B officer and promoted to group A after retirement

See as per the NCL rules if father was promoted to class A after age of 40 years in that case you shall be in Non creamy layer category.
This income from pension shall not be considered for this purpose.
Father directly recruited to class B and promoted after age of 40 you shall get benefit as per NCL rules.
If only one of your parent is class 2 employee and other is below class 2 or unemployed then you fall under OBC Non Creamy Layer.
Your father joined as Gp-II employee and then promoted to Gp-I cadre after 40 years of age hence his wards are eligible for OBC NCL category reservation, salary or pension amount is not considered while computing the annual income of the family for the threshold limit of Rs. 8 Lakhs per annum.
Joining as Class-II or Group B employee with the spouse not employed shall not push their wards to creamy layer especially if promoted to Class - I or Gp-B post after 40 years of age.
You are eligible for non creamy layer category reservation.
If your community is coming under OBC category list then you will be eligible for Non creamy layer reservation or privileges.
- If anyone of, father or mother is direct recruited class 1 servants than their children won't be eligible for NCL. But if he/she is promoted to class 1 then the kids will be eligible
- If both of the parents are class 2 than their kids won't be eligible for OBC quota but if only one of them is than the kids would be off from creamy layer and they can avail benefits of quota
- If father was recruited direct to class 2 positions and then prompted to class 1 before age of 40 than it would be no longer NCL.
- The government servants who don’t fall under this category are all non-creamy layer.
- Further, Government Employees of Class 3 or below class 3 officers are eligible for OBC Quota., and the salary/ income of the government employees are not to be taken into consideration for considering the OBC NCL category certificate.
- Since your father was working under Group B category, promoted after the age of 40 to Group A, hence you are eligible for OBC-NCL reservation , and pension amount after retirement will be not taken into consideration
