• Endowment notice

Hi sir,
We recently received a notice from the endowment department regarding a property (land) which is inherited by my father . currently my father is no more also the property is declared as undivided hindhu joint property my father has a brother .is he also answerable to the notice or is it only my mother or myself who is the legal heir answerable??
What if we want to surrender??

1. Only you and your mother as legal heirs of your father are answerable to the legal notice if property is self acquired property of your father 

2. And if it is ancestral property or undivided property of your grandfather then your uncle will also reply to legal notice as party.

1. There is no need to involve Uncle, since Mother & you are the legal heir of deceased father.  Also there is need to surrender the property and neither the dept., has any right to claim anything from you.

2. Depute a property lawyer and ask him to scrutinize the Notice and prepare reply.  Also arrange for the property to be mutated in your name, by filing civil court suit and seek directions to the Tahsildar. Let the matter be in dispute and ultimately the property would be transferred in your name.

Endowment Definition: The devotion of property to a specific and particular trust. Related Terms: Bequeath or Bequests, Legacy, Charity. The transfer of money or property (usually as a gift) to a public or charitable organization for a specific purpose, such as medical research, parks or scholarships.

Are you sure that this property belongs to your family and has been declared as HUF property.

If so, then you may have to give a reply to the notice denying the allegations made in the notice by the concerned department and produce documentary evidences to support your claim.

If your uncle  received a similar notice, let him give a reply, you concentrate on your case alone.

The notice, if issued on your father's name, since you and your mother and your siblings are the legal heirs, one of you representing all the legal heirs of your deceased father can give a reply notice either by yourself or through a lawyer and pursue the matter if it is escalated through any legal forum or court, by the department concerned.
