• 26AS form and Details with PAN card

Hi,

Tax files directly by office. No ITR filed.
Can wife know about it through PAN(domestic matrimonial cases going on), say for

My second question is Which rule says that if the tax is directly submitted by office and the person concerned does not need to file ITR if the salary is below 5 LPA.

No she will not be able to know the AS26 details.

There is no such file and you have to file your ITR based on your income and tax deducted. AS26 provides the details of income and TDs deducted at different sources of income.

f your income is up to Rs 5 Lakhs you pay zero tax, but you must still file ITR. The income tax exemption is Rs 2.5 Lakhs a year for citizens below 60 years and Rs 3 Lakhs a year for senior citizens between 60 to 80 years. If you are earning anything above these limits, it’s compulsory to file ITR."

 

2) an earning individual can claim a rebate on tax payable if the taxable income is up to Rs 5 Lakhs under Section 87A. If your income is up to Rs 5 Lakhs and you don’t file ITR, you will get a tax notice. Filing ITR is mandatory if your income is more than the basic exemption limit (Rs 2.5 Lakh a year) for citizens below 60.

Your wife can view your Form 26AS online or she can download it in PDF or Excel format, but for that, she need to register on the income tax website.

In any of the following situations (as per the Income Tax Act), it is mandatory for you to file an Income Tax Return in India. Your gross total income (before allowing any deductions under section 80C to 80U) exceeds Rs 2.5 lakhs in FY 2018-19.

The income tax exemption limit for all citizens below 60 years still remains at Rs 2.5 lakh and for senior citizens Rs 3 lakh.

Therefore, if you are earning anything above these exemption limits annually then you are mandatorily required to file your ITR. You can claim the rebate of all tax payable if your taxable income is up to Rs 5 lakh under section 87A in your ITR when you file it. If you have income up to Rs 5 lakh but don't file your ITR assuming that your tax payable is zero your taxable income is up to Rs 5 lakh under section 87A in your ITR when you file it. If you have income up to Rs 5 lakh but don't file your ITR assuming that your tax payable is zero you are liable to get a notice from the income tax department.

 


Your wife can get the tax paid details and the salary details through court also by filing a petition before seeking direction to the employer to produce the details, the employer has to obey the court order if the court passes an order to this effect.

1. She can file a petition before court seeking direction to the income tax department by quoting your PAN to obtain the income details for the TDS paid.

2.  There is no punishment for that but she will get the details of your income by which she can claim the maintenance amount accordingly.
