No she will not be able to know the AS26 details.

The Family/Trial Court can direct parties to furnish detailed affidavits regarding their income, expenditure, Assets, and liabilities in terms of direction laid by the Hon’ble High Court of Delhi in the case titled “Kusum Sharma Vs Mahinder Kumar Sharma”
It is further relevant to mention here that the Hon’ble High Court of Punjab & Haryana in case titled as “Joginder Singh Versus Rita & Another” had directed the Registrar General of High Court of Punjab & Haryana to send a copy of this order (“Kusum Sharma Vs Mahinder Kumar Sharma”) to all the District & Sessions Judges in the states of Punjab and Haryana as well as union territory, Chandigarh, so that direction may be issued to the concerned courts to adopt the procedure laid down therein.
therefore, you cannot hide any financial information from the court in lieu of above order,
Though HARSH but TRUE,
- As per the proposals of Budget 2019, there will be no tax liability if your taxable income is Rs. 5 lakh or less.
- However, ITR filing is mandatory if your income exceeds the basic exemption limit .
- No, she cannot know about the details of 26AS with PAN card only.
f your income is up to Rs 5 Lakhs you pay zero tax, but you must still file ITR. The income tax exemption is Rs 2.5 Lakhs a year for citizens below 60 years and Rs 3 Lakhs a year for senior citizens between 60 to 80 years. If you are earning anything above these limits, it’s compulsory to file ITR."
2) an earning individual can claim a rebate on tax payable if the taxable income is up to Rs 5 Lakhs under Section 87A. If your income is up to Rs 5 Lakhs and you don’t file ITR, you will get a tax notice. Filing ITR is mandatory if your income is more than the basic exemption limit (Rs 2.5 Lakh a year) for citizens below 60.
Your wife can view your Form 26AS online or she can download it in PDF or Excel format, but for that, she need to register on the income tax website.
Unless and until judge ask you to produce 26AS FORM in the court. No one can check online without you and CA or Tax filer.
Thanks Gentlemen. But I have got different responses. I have not filed ITR for the past several years owing to my matrimonial case, but the tax has been deducted and I have got Form16 from various organizations. My divorce case should clear by 2020 maximum and I will all the ITRs after that, offcourse with fines. Actually, I might have to get some money from the government If I get my Form16s reviewed Now, My basic and very simple questions are. 1. Can she know, either through court order directing the Income Tax department to give information of my TDS(through Form 26AS or any other), through RTI(filed by her) or by other means. A of now, it seems its unknown to her weather I have filed the ITR or not. So any information related to ITR will get no response from the Income Tax department.(Last ITR was filed in assessment year 2015). 2. What sort of punishment do I have to face if in the end the details of my TDS are known. PS: Please answer in serial order as asked above.
1) Section 8 (1) (j) of the RTI Act does not allow divulging personal information.
It says: “Notwithstanding anything contained in this Act, there shall be no obligation to give any citizen information which relates to personal information the disclosure of which has no relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual unless the central public information officer (CPIO) or the appellate authority is satisfied that the larger public interest justifies the disclosure of such information.”
2) wife can obtain court orders to direct income tax department furnish information of TDS deducted
3) she can also obtain details through RTI
4) information commission can in the interest of natural justice direct net taxable income of both should be disclosed to him.
If ITR is not filled than how she will come to know that from where and which company you get form 16. Unless n until you tell her.
1. Yes she can file RTI and get details about your income from Income tax department.
2. You will not get any punishment until you give false statement in court.
Though a taxpayer, whose income is up to Rs 5 lakh, is not required to pay any tax, yet he is required to file ITR if his income exceeds the maximum exemption limit. Any late filing of return would invite the late filing fees of Rs 1,000 under section 234F."
