• Selling agriculture land

I have registered for agricultural land.I want to sell the land due to neuro disease and I don’t have any earning. I have no possession of land due to health issues.I sent a land-buying party to land. the local village people are creating rumors that the land does not belong to me. the buying parties not interested to buy even a have clear title of the land.

I need legal advice on how to sell the land or can I approach the court to sell my land, or trees passes will be prosecuted. what is the procedure.

You should go and stay in said land then attempt to sell it 

 

if buyers find you are in possession of land and have clear and marketable title to land you would be able to sell it

Hi,  there is no need to approach the court.  If you have a title over the property you can sell to third parties.  Locals can't object for the same. If they have any issues then they will approach the court.

First you have to climb the position of the land in in case the land is encroached by anybody before you find out the prospective buyer.

If you have clear title of the property then you don't need permission from any corner. 

If the physical possession is not with you then you can anyway get buyer but price may be less. 

Otherwise file suit for recovery of possession, get its physical possession from court and then proceed to sell.

The registered sale deed on your name would confirm the title to the property, however if it has been encroached or grabbed or occupied by any third person, then you may have to first regain possession of the property by filing a suit for ejecting the unauthorised squatters in the property and after taking possession you can sell the property and deliver vacant possession to the prospective buyer.

1. It will not be possible for you to prove that the village people are passing rumour.  Moreover, there is not provision of law to punish such rumour mongers in personal matters.

 

2. If there is any trespass in to your land, then you shall have to lodge a police complaint against those trespassers.

 

3. It will be prudent on your part to take the next buyer personally to the land personally.

- You can lodge a compliant against those persons , creating problems in selling the said agriculture land for the offence of trespassing and threatening . 

- If no legal action taken place , then you can file a suit for permanent injunction before the court to restrain them for creating any trouble in selling the said property.
