• Fake call for Job

I received fake job oppotunity call from a lady. She took the name of an MNC and told we have a job opportunity. I provided all my information to her about carrier, descriptive family details etc. She responded I ll call you later and never called back. I checked her name on truecaller and linkedin profile, she doesn't work in that MNC. And she doesn't pick the call anymore. Can I take any legal action?

Until she do not misuse your information, no criminal case. And as a precaution, you can submit written complain to police that some women took your all information on the pretext of job and vanished.

 - As per law, Whoever is trying/attempts of hacking/intrusion or trying to cheat on the name of job /work etc , then such person shall be punished with imprisonment up to three years, or with fine which may extend up to two lakh rupees, or with both.

if, you have no proof of the same , then it will be difficult to lodge a complaint.

- However, since she has taken all the information , then there is chances for misusing the same as well,

You should register a Cyber Crime FIR at the nearest local police station to report them, because as per law, It is mandatory under Section 154, CrPc for every police officer to record the information/complaint of an offense, irrespective of the jurisdiction in which the crime was committed.

- Further , you can submit your complaint Online mode as well. 

- It is their duty , to trace the culprit , who is trying to do this crime.

What action can you take on her?

She has not cheated you by taking money or receiving any consideration towards the job offered by her and did not get you employed.

If at all there is a substantial loss to you due to this you can proceed legally by getting her address and issuing a legal notice demanding explanation for this scandalous act.

If it is ignorable then you may ignore and move on in your life, you may be coming across many more such fake people.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting Documents & Witnesses.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet.
