• Related to property documents

My query is...if there are four co-owners of a property and one of them has kept the property papers in his possession and denies to produce the documents on request/demand of the other co-owners when needed...then can the demanding co-owners make a police complaint against the possessor to recover the papers for all the co-owners?

Yes you can make a police complaint. First give the co-owner a written demand for this. Then after if not produce the property paper, complain to police.

immediately issue legal notice  claiming property papers in a week. if they failed  lodge a complaint to the police.

If the property papers are by registered deed, then you can easily obtain a certified registration copy from the concerned registrar's office also.

In normal circumstances he cannot deny, however the police may not interfere in this civil nature dispute, you may approach court for a direction to him to produce the documents before court for the reasons you rely upon.

- Since , there is four co-owners of the property, hence as per law, all the owners have equal right to use the property paper /documents as well.

- If the origionla documents are in possession of one, then he should produce the same when need by others. 

- After denying the same , he is doing breach of contract as well, so others can lodge a police complaint for the same. 

- However , for removing the dispute permanently. other co-owners can get orgional certified copy from the Registrar office of that property papers, and the certified copy has also legal value in the eye of law.

See you can give a police complaint and issue legal notice though police may refuse to take complaint in case they refuse you have to file a civil suit.

1. No. There is no criminal offence for refusing to give property papers.

2. However, each co-owner can apply for "certified copies" of ALL the property documents from the Tahsil /Municipal offices and such certified copy is deemed as original copies for all futuristic legal purposes.
