• Arms act

What is the least age at which any person can possess arms in India. Does it differ from state to state. Also if a person is found to inherit a Gun on the basis of illegal, wrong or forged documents (related to inheritance) then apart from IPC sections would it attract Arms Act sections as well?

One must be 18 years of age.

Ipc arms act would apply to all sort of illegal possession of fire arms.

Read it as 21 years age. It was typing mistake. I should correct the figure.

1. Legal Age to own Fire Arm in India is 25 years. However some relaxation is possible in different State territories as per State Govt. rules, by giving proper justifications /reasoning's.

2. IPC and Arms Act, both will be applicable for forgery, cheating, misrepresentation and possession of Fire Arm, irrespective of the inheritance or whatever ....

As per rule 36 of the Arms Rules, 2016 any person below the age of twenty-one years but not below the age of twelve years may be allowed to use permissible category of arms for the purposes of training in the use of such arms in the immediate presence, or, under the direct supervision and guidance, of an adult instructor or the licensee.

The provisions for grant of licences are contained in rule 25 of the Arms Rules, 2016. The licensing authority may grant a licence ─
(a) after the death of the licensee, to his legal heir; or
(b) in any other case, on the licensee attaining the age of seventy years or on holding the firearm for twenty-five years, whichever is earlier, to any legal heir nominated by him:
Provided that notwithstanding the provisions contained in rule 12 of these rules, the licensing authority may grant a licence to such legal heir if the eligibility conditions under the Act and these rules are fulfilled by the said legal heir and there are no adverse remarks in the police report.

Procedure for Transfer of Arms License. Transfer of Arms License can be done on two conditions - a) When the original licencee is alive- 1. During his life-time, the licencee may transfer the arms licence to legal heirs by making an application in plain paper.

Minimum age for an arms license is the same through out India. It's 21.However in case of "Junior Target Shooter" it is 16 years.
