• BDA layout approval for a single sub divided plot

I have been searching for BDA approved plot to buy in bhubaneswar for more than 2 years now but i am not able to find any. Some developers are carrying out plot selling without taking BDA layout approvals by direct ownership transfer from the local land owners of the plot to the interested new buyers by just acting in middle. When I am getting any individual plot seller, he is not interested in getting BDA layout approval before selling his plot. In such a scenario I would like to offer the individual plot sellers to take all the burden of preparing BDA layout approval of the subject individual plot by doing those formalities on his behalf for him to sell me the plot without any burden on him. I actually do not know how to do that. And querying at BDA office is not a very easy work for an uninfluencial person like me as I have bad experience visiting the office. I would like to even meet someone who can help or advise me regarding all the law formalities to be able to buy a land peacefully by following the rules and guidelines.

You can contact a local agent for the same having expertise in the same. But I endorse your decision of layout approval.

Dear you should contact a local advocate who is practising in property matters.

He must have connections and knowledge about requirement in BDA office.

Your task will be much easier with help of an advocate.

Without approval by authority on the plot now proposed to purchase would become a problem in future and you may not be able to get the clearance especially if you have to sell it to a prospective buyer. 

Hence you may contact a local consultant for this purpose and get the task completed legally.

Once property sold, seller no more responsible for approval and such commitments are not enforceable if approval is prohibited or have conditions to fulfill which are beyond his capacity to perform.

So better first ask seller for approval and than only purchase.

- As per Bhubaneswar Development Authority notification, Real estate developers in the Odisha capital cannot sell land without an approved plan.

- Further, a criminal proceedings can be initiated against the seller of the land , and also can be arrested if they violate this clause , on the complains of any buyer.

- As per this rule, it is mandatory for the buyers to keep 40 percent of the total land free for community use and allow construction to be carried out only in the remaining 60 percent space.

- Hence, you are not suggested to purchase a plot without the BDA approved layout plan.
