• Can I build on my farm land?

We have a 0.5 acre farmland located in Khed Shivapur area outside Pune. It is an agricultural land but we have never been involved in agricultural activities ever since we acquired the plot 10 years ago. 

We are planning to build a house on the barren land there. But I don't understand if I can build on the property legally. If I can, what is the maximum area can I construct and how many floors am I allowed? I have tried to look online and figure out the local regulations but I don't understand. 

If possible we would like to build 10,000+ sqft. private residence (which includes ground floor, first floor and a basement) for my family as we plan to move out of the city permanently. Can you help me with things I should know and steps I needs to take to make this happen?

See to builder in that larger area you need to convert the land to Non agriculture land fir same you need to file an application before the Revenue authority pay conversion fee and then after taking approval on construction plan you can build.

You can not construct residential building on agricultural land without changing the agricultural status of the land.  However, you can construct any building or shed,  to be used solely for the purpose of carrying out  the agricultural work.

You can apply to district commissioner or collector to change the status of your land with all documents and history of land activities .

1. IF the 7x12 defines the Land as Agricultural Land THEN you cannot construct any type of permanent structure on the same.

2. You will need to get it converted into Non-Agricultural Land, thru the office of the local collector, and AFTER this get a House construction Plan prepared by a registered architect and have it sanctioned by the local Town Planning Office (under the collector office).

3. The above is the legal procedure. Normally people construct houses and usually nobody cares about it.

If the land is exclusively for agricultural purpose legal permission to construct will be cumbersome. You need to change the use of land

Agricultural land cannot be used for residential purposes. You cannot construct a house on agricultural land to live in, although the land may be owned by you. ... You can convert agricultural land into residential or industrial land by paying a fee

The conditions for construction of agricultural land are described in Regulation 2 for construction of agricultural land under the Law on ownership and use of agricultural land when its use is not changed. In such cases, it is permitted to construct buildings related to the use the land.

No, you won't be able to build 10k sq ft, maximum you can built a 700 sq ft to 3000 sq ft for 1 Acre as farm house that also for self residence.

 

You have second option to make plot N.A. by collector sanction and than built 14k sq ft. Building for residential purpose.

Max can build up to 500 sq mtr rest portion shall be use for farming or agriculture purpose. ground + first floor is permitted.

- As per law, you cannot construct a house on farmland to live in, even you are the owner of that land .

- Before construction a residential house, you will have to convert the said farmland into residential land after paying specific fees.

- You should apply to the commissioner/collector of the land revenue department, explaining the purpose of conversion.

- File an application, with ID proof, mutation letter, original title deed , latest tax paid receipt and certified survey map.

- After verifying that there are no pending dues or litigations on the property, the commissioner/collector of the land reveneu department , will issue a conversion certificate in your name.

- In Maharashtra now up to 10 hectares plot can easily get permission from collector after one time fees mentioned in the ready reconer.

No legally you cannot builder any house on the agriculture land without conversion of land. 

You should apply for conversion of land use and after that you can get approval for floors of building.

For constructing a multi story building in an agricultural land, you may have to first get it converted to NA by following the procedures for the same.

 Once your conversion is approved then you may apply for approval of construction in the plot as per your plan and design.
