• Residential Property - Survey #

This is property related , I am from India, Hindu family. The original sale deed includes half share of my father's name and other half share of mine ( joint property ), this was bought in 2016 and now my father would like to release it to my name. The original sale deed included the Survey # near the address details and now in the registration office they are saying that the survey # is showing under government jurisdiction so while preparing the release deed we will exclude the survey number and prepare it because the registrar is not agreeing to complete the process because the survey # belongs to government jurisdiction. 
Is it okay if Survey # is excluded in the release deed for a residential property?

you can exclude survey number as it does not relate to your property 

 

2) it has been mentioned in sale deed to show its location only

If property is of 100 mrts than 50% share will be release, No mention of survey no. It will only mention, property is in joint ownership and co owner wants to release his share to you.

- A Survey number is a unique number assigned to a specific piece of land to maintain records.

- The record contains the information about the location, size, shape, and ownership of the land, and is created by the surveyor.

- Hence, you can exclude the Survey number .

Yes it's okay to exclude survey no.  From the release deed if other details of property is mentioned in the release deed.

Without survey number you cannot register the release deed and unregistered release deed is not legally valid. 

Moreover he has to transfer his share in the property by executing a registered gift deed only and not the release deed.
