• Betting in online site

I am having account in online betting site betchips.in and used to frequently deposit in accounts provided by them mainly paytm bank account of people in West Bengal.. And also used to withdraw after winning since 6 months... This time I had 1lakh 40 thousands in my bet account and they have suspended my account without any reasons... I am unable to login into my account... What legal actions I can take???

Betting in any form, i.e. physical, via E-mail or Online is not allowed in India. As the premise on which you have put your money on stake in itself is not legal and valid, you can't recover your prize money.

This is a fraud committed by many such websites which are online and accepts accounts from the bank accounts and later dupe people. You need to file complaint to cyber cell and then follow up.

IF THE ONLINE BETTING IS LEGAL ENOUGH, THEN:

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud, breach of trust etc.... against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.

- Online betting is at some extent is illegal in India , but not entirely, and that is the reason Betting is online fund transfer or credit card payment.

- Hence, as per alw , you cannot punish and further you cannot complaint against the rule of the online betting game.

- Further, Law will not protect you if you are cheated by the provider of the game.

- Since, your payment was mainly via paytm mode, so you should ask them reason of suspension.

You should send inquiry to their customer care to get detail about suspension of account.

If they doesnt give any fair reason then you should lodge FIR against the betting site for fraud with cyber crime branch of police.

First of all ascertain that if this online betting is legal or not and if it is legally recognized then you may first issue a legal notice to the online betting website to their address.

If they dont comply with the demands made or there is no response then you may initiate further legal action for recovery.

Police can't stop your work as the same is civil case and police don't have any power. You can complain to the higher authority of police or approach court for justice

You have to file intervenor application for being added as party to suit

If there's a litigation pending along with an effective stay order for restraining the respondents from alienating or encumbering or any other activity in respect of the suit schedule property,  then the order is binding on all the respondents participating in the case pertaining to the schedule of properties under the current legal dispute. 

You can file a petition to vacate the stay order or permission to construct your portion of property which may not be under dispute  before the same court. 

No writ petition or police complaint is maintainable.
