• Buying agricultural land

My father is a retired govt employee, he want to buy a agricultural land for building house, is there any restrictions?

Location- salem , Tamilnadu

Note- ( during the green expressway crisis, our area entitled as mountain village thus further land approvals for plots were stopped)

In Tamil Nadu, there is no restriction for Purchase of any Agricultural land by resident indian . Anyone can Purchase an Agricultural land. The provision of Land Reforms Act states that a family with five members can maximum own 15 standard acres of agricultural land.

Madras HC has banned conversion of agricultural land into housing plots or for commercial purposes

2) it banned registration of un approved housing plots without approvals

3) HC banned the registration of plots and houses (for the sale deed, the transfer of ownership from seller to owner) that had not secured approval for the change in land use from agricultural to residential from appropriate authorities such as the Directorate of Town and Country Planning or the Chennai Metropolitan Development Authority.

4)land use of the plot can changed from agricultural to residential.and then construction can be carried on the plot for building house

5) according to Tamil Nadu Panchayat Building Rules, 1997, only the Directorate of Town and Country Planning can sanction housing plots,

As per law we cannot construct a building on agriculture land for live in .Hence agriculture lane cannot be used as residential purposes.

we can go with as legal for that some procedure needs to follow to convert from agri to residential purposes.

In Tamilnadu Most of People's used to construct a building on agriculture land in rural areas after obtaining the necessary approvals from local authorities.

You can't do construction in that land without converting it to NA land. You need permission for the same as aforesaid

Dear Sir,

Subject to local laws and circulars issued by local authorities , the general rule is that one cannot construct residential house on an agricultural land unless it is converted into non- agricultural land.

The 2nd option available to you is to go ahead to construct , farm house instead of residential house but you may not get any house loan subsidies etc .

Your father can buy the agriculture land in Tamil Nadu if he is an agriculturist or belong to family of agriculturist.

And if you want to change the land use for housing purpose then you need to get permissions from the authorities for building the house on that land

He cannot buy agricultural land for the purpose of constructing building because the registration of such lands are stopped till this date.

In any case he may make an enquiry about this with the land revenue department and proceed only if gets a positive reply from them in this regard.

Yes,  without conversion of agricultural land to NA you will not get DTCP approval.

If you still go ahead with the construction, the authorities may put a sel on it or even demolish the same considering that as an illegal structure.

The cost for DTCP approval can be enquired from the concerned office.

The land has to be NA converted first and then obtain approval from DTCP.

Dear Sir,

15 standard acres per family, in addition each family member(extented families) can hold another 5 acres per member. Standard acre is little less or more than an acre .It is decided by quality of soil,land tax etc
