• Can we register in passbooks more aggriculture land than veriginal value.

There is a agriculture land of my grandfather, my father and brother of my father made register equally around 68.5 cents and my father taken share of his brother in that land and given him in another land and we given 50 cents to my sister and my father was expired in 2015,now I am asking brother of my father to register that remaining 18 cents and he is saying that the actual share of each one is 62.5 cents, but we have register 68.5 cents and online value also showing same 68.5 cents and now I will register only 12cents and if need 18 cents I need pay money for remaining 5 cents of land .

my question is , is it possible to register more land than actually land? if it's not possible to register 68.5 cents instead of actual 62.5 land, can I fail a case?

2) if your grand father had purchased 68.cents of land by registered sale deed but passbook reflects less area of land ie 62.5 cents you can file case to direct revenue authorities to register 68 cents of land in passbook

Sir property shall be registered as per the document and records if there is mismatch then you have to get the previous records rectified the property has to be surveyed and based on that you have to register the remaining property.

You cannot get registration  of more land than actual extent, it is not possible.

In case, if you have link documents showing the uncaptured part, you have the option of going for rectification.

No, you cannot file case against your uncle, it is not a cheating case. 

May be it is a typographical error at the office, and that, you may check the documents which were presented for registration originally.

You can file a suit claiming possession of actual landed proeprty due to you from him as per the records.

Let the court decide after hearing both the sides and scrutinising the relevant documentary evidences submitted by both the sides.

You may have to put forth your arguments strongly on the support of the documentary evidences in your side.

You already have registered 68.5 cents to your account, hence you dont need to have a fresh passbook for this, the old one will speak as record or documentary evidence to support your pleadings.

On the basis of the evidences you can claim your remaining part of landed properties from him and you can file a suit against him for this.

This may not come under criminal case, you may have to fight agaisnt it through civil court only.

No it is not possible to register the land which is not there actually.

You cannot register more land if the actual land is 62.5 cents. 

It will be a fraud case against you if department or other land owner find this discripency in the records.
