File police complaint against noise pollution in vicinity of your institute due to loud speakers from neighbouring shop
2) noise ambient level cannot exceed more than 55 DB during day time
3) if no action is taken by police file suit seek court orders restraining neighbour from blaring songs at high noise level from speakers on display in his showroom
It is advised that you file a suit for permanent injunction against your neighbour. Meet a lawyer and prepare your case accordingly. Court will issue directions even to state authorities to take necessary actions to stop nuisance.
Dear Sir,
Yes, calling a police if your neighbor harasses you is an option to go with. You have the option to call the police by just dialing the police number 100 and police will come to the place mentioned by you in the phone call. They will come to the spot and ask you the problem and then will take the action against them. And, when they will reach the spot you should be having sufficient proof to prove the harassment by neighbors.
You may be living in an apartment or in a duplex, often it happens, when you hear loud music sound from the neighbor’s house, you try to ignore that sound for as long as possible but sometimes, such noise may make life difficult. This type of nuisance is defined in Section 268 of the Indian Penal Act.
Section 268 of the Indian Penal Code defines nuisance when the person is guilty of a public nuisance when he does any act which causes injury, danger or annoyance to the public or the people in general who live or occupy the property in the neighborhood.
A common nuisance is not excused on the ground that it causes some convenience or advantage.
If this type of harassment is faced by you from your neighbor then, you can file an application under Section 268 of IPC in the court of magistrate.
Dear,
The best option for you to file police complaint against him for noise pollution.
If police is not taking any action then file petition in court and take direction from there.
Dear Client,
Playing music on high volume and loud speaker is not permissible. Complain to police, warning will issue and for repetition his instrument will seize by police and will book him for creating nuisance.
You can file a complaint to police and later file a case under environmental protection Act and noise pollution rules
The neighbor cannot play his set on a high pitch sound and that too on permanent basis.
If he's not acceding to your request then you may lodge a complaint before police and seek proper legal action to curb the menace.
You should lodge a complaint against your neighbour for Public Nuisance with police due to which you are not able to perform your work.
