• CMC Khata is valid for registration?

Hi,

I'm planning to purchase a resale flat from Prestige Sunrise Park, Electronics city. I have got sale deed, EC and OC and verified. 

Now the problem is with Khata. When i asked for Khata, he has given tax paid receipts and CMC Khata (KMF 24 Form., property tax demand, collection and balance form)

With CMC Khata, can i go for registration ? Is there legal hassles with khata transfer in future ?

Areas coming under CMC were merged into the Bangalore Mahanagara Palike to form BBMP. Owner has to apply for a Khatha from the BBMP. The CMC approval should still hold good but A khata is still due which will issue if no dues from 2007.

is just a receipt/tax assessment extract and not .khata

Yes the title is clear you can go ahead with the purchase. No there won't be any problem after sale you can with index and deed copy get khata transferred.

CMC plots can be registered.CMC plots properties have already come under the purview of BMP. better consult local property lawyer.

Earlier apart from Bangalore Corporation the following civic bodies were functioning in Bangalore. They are CMCs in Bommanahalli, Dasarahalli, Byatarayanapura, Rajarajeshwarinagar, Yelahanka, K.R.Puram, and two more places.

Many private layouts came up under the above mentioned CMC area. The residents had taken Khata for their property and many of them had paid their taxes for both constructed houses and vacant plots.

Later onward, all the areas under these CMCs were brought under BBMP. 

Dealing in property in the CMC areas is complicated. You should check the documents of the property thoroughly for its genuineness and a legal opinion is a must before advancing on a property as a lot of bogus documents are in circulation" 

You can get the khata transferred to your name from BBMP and get the property registered on your name.

CMC means city municipal council.

They were authorised to issue khatas then and have been stopped to issue them anymore from the year 2009.

Yes if CMC khata and tax paid receipt are available with seller then you can go ahead with registration of property. 

It will not create any legal hassle if the property papers are available with the seller.

Dear Sir,

Whenever a properties purchased there will be 20% risk. Since it is a BBMP situated property so you must have Katha from BBMP authorities. Possession will be considered as 9 points in law. If other things are good you can purchase the property and leisurely get BBMP Katha.
