I am staying in a flat in Bhubaneswar, Odisha. I am renovating that apartment. I am staying on top floor I.e 6th floor. The problem is that , those people who are staying on 5th floor below my apartment complaining that I cannot build bathroom & toilet over the kitchen of 5th floor. Is there any such rules that I cannot build ? Kindly help

As an owner what approach I should follow and what documents i need to carry on construction. My society has told me this is a structural change and I cannot build toilet where mine kitchen was present and 5th floor kitchen also present below that. What is the solution to this problem. ?
This will definitely object by co members in building. As it`s alteration of actual/common plan and that too in such way which may disgust below owner kitchen space/ceiling.

As per facts, firstly you have to follow the guideline & rules of the society if any regarding modification of basic structure of the building, then you can change it, otherwise not.

If your activities are structural change and you cannot do that in case you do that that can be demolished by the development authority on the complaint of your neighbours you need to go as per the development plan and building plan has been approved by Development Authority the resident welfare Association is empowered to take any decision in this regard and they send you notice and impose penalty for any structural changes in the building you are right as a apartment holder is limited to to use of the property and do the normal repairs and maintenance you cannot make any changes to change the layout of the apartment
You cannot restructure the building as per your will and wish at any time you may feel so.
You have an approved construction plan approved by the authorities concerned hence you cannot deviate any construction beyond the approved plan.
You can carry out minor repairs which would not alter the structure in any manner.
If the society is initiating action on this then the authorities may order for demolition, hence do not take any risk.
