• Our daughter is back home after 5 months of marriage - her husband is uploading obscene pics online

Now that we have filed dowry, dv, maintenance, .. We are not getting any strong response either from police nor court. Date after date. The guy doesn't turn up on the court dates.our lawyer says .. He can do three times and on the fourth by paying some money as fees to court. Its is very disheartening that inspire of court orders to arrest the boy... Nothing is seen to happen. He is now uploading bed room pics on fb, insta, twitter and also sending friend request to all of our family members and our friends on fb. The profile has our family pic on background and our dgtr pic in the middle .
How to move ... SP had instrucred the Area Police to fike a FIR , but they did not, instead FR was made saying that husband can put her pics .. There is no issue... as because divorce has not been filed .. Pl assist

What types of pic is he uploading on social sites, whether is nude pics than you and your daughter can file defamation case against him.

Ask your lawyer to put an application to S.P of your district that they are not working as per your direction then they will be on kness and will have to file FIR against him as it is matter of privacy and that is a fundamental right provided to everyone by Indian constitution ...and put screen shot of that all which stuff he posted on the social media that will help too ..

 in case there is nothing happening in your case then you have to file a writ petition in High Court in the nature of mandamus writ petition to get the direction for police from the court to take appropriate action after filing the FIR you can also add in your FIR section 66 and 67 of Information Technology Act for posting the posting the absence material  on Facebook if even after the order of the superintendent of police nothing is happening then the high court is the only option available to you

See file a writ before high court to get direction for cyber police department to.file FIR that since he is using private and personal pictures along the name. The high court will order police to register FIR and present report.

Doing the above is punishable both under different provisions of the Information Technology Act and IPC.

SECTION 67 of Information Technology Act According to this Section, anyone who uses electronic means to publish any picture, video or audio or anything which is capable of defaming a person morally will be considered as a crime and the person doing such an act will be punished with imprisonment.  you can make a complaint to a higher ranking officer such as the Superintendent of Police (SP), the Deputy Inspector General (DIG) or the Inspector General of Police (IGP).You can also complain to the nearest judicial magistrate, who will order the police to register the FIR if deemed necessary.

The husband is acting weirand hence a petition must be filed in the jodhpur high court so that it gives appropriate directions to the concerned police station so that the husband may behave responsibly and you should also file a divorce petition. You can withdraw it later in case the things settle.

This is absolute bull shit. Dose police said in FR, that husband can put such pics. File writ in High Court sitting the report of police. Investigation officer will be terminated.

File another FIR under I T act and molestation, through court. Your advocate is incompetent. Change advocate. In such kind acts, instant arrest. Report to media, best recourse.

Approach women cell. IF SP is unwilling , approach IG.


Insulting modesty of women, serious crime, no bail for months. And he is not appearing in court, court will pass ex parte order on same date.

Your daughter should file case for judicial separation against your son in-law.

And meet SP again with copy of FIR and tell him that police is not taking any action against that person and is not taking action under some influence best known to them.

The uploading of pictures in Facebook or any other social medias may attract cyber crime offence, hence it is to be dealt with by the cyber crime police only, you may appraoch them for necessary action against him for spoiling her name and fame through social media network.

Once the case has been taken on file by the court, then the role of the police ends up, now the trial will be conducted by court alone.

  2. The cases in which you have the orders, you should file a contempt of court before he Hon’ble HC and then see that the authority would arrest him also.
