• Money Distribution problem in family

I belongs to HINDU religion, my father died working in a PSU (Public Sector Unit) hence company transferred some money (my father’s remaining job salary) as a compensation in my mother's account according to their policy. My father didn't made any will or nominee in his life, so my question is – According to Indian Law "Can any family member (like my grandmother, brother etc. ) challenge that compensated money for distribution?"

Hi,

The money received by your mother as survivor  of your father can't be shared by your brother. You are suggested to file complaint through your mother against that brother and ask for protection.

She can file a FIR against them to the nearest police station.  She can also invoke domestic violence Act provisions against them

The money transferred to your mother's account as being nominee of your father now she has the soul right over that... You can now make a will by means of your mother... As in your favour.. And make it registered with the office of sub registrar... Then your brother will not do anything...

The Terminal benefits of your father will definitely go to the mother and nobody will have share in that but in the case of absence of a will the property will be divided among the first class legal Heirs which are the wife and the children in absence of the wife and children only the second class legal Heirs may claim the property so in your case all the liquid benefit which has been passed to your mother remains with her and nobody can claim that amount but all the  non movable properties will definitely be partitioned among the legal Heirs including mother

Since this is not an intestate succession because it is the terminal benefits payable to the next of kin as per the service records, the other legal heirs cannot claim any share out of this terminal benefits. 

It can be challenged properly if somebody claims it.

No one can claim the share from the compensated money from the employer because they transfer the money to name of nominee in company records. 

Your mother can file a suit for eviction and maintenance against your elder brother Under Maintenance and welfare of parents and senior citizen act.

Also she can file a ccomplaint case of domestic violence against her son for getting protection order from court.
