• Non-agriculturist wants to buy Agri land and use for industry

I am a industrialist in nasik , I have work shop on rent in ambad industrial area. As rates very high in ambad MIDC, I wish to buy Agri land and then NA this land and then wish to use for my industrial purpose. But I am not agriculturist .
How I can go ahead..

Respected sir... 

There is very simple procedure first of buy an peace of land and then apply in the department of district town planning to convert the same land from agriculture to commercial land... For that you have to do some formalities after that they will give you NOC and then you can use that land for your industry...

See you can purchase an agricultural land outside maharashtra in state like maharashtra based on there record you can purchase agricultural land in the maharashtra.

You can still purchase agricultural land by filing affidavit that you have interest in agriculture and desires to pursue the same.

Earlier in the State of Maharashtra, a non-agriculturist could not acquire agricultural land without the prior approval of the Collector. On 1 January 2016, an amendment was made to the existing law to allow a non-agriculturist to acquire agricultural land subject to certain conditions

2) the following lands would be excluded from the purview of Section 63 of the MTAL:

Land situated within the limits of a Municipal Corporation; or

Land situated within the limits of a Municipal Council; or

Land situated within the jurisdiction of Special Planning Authority; or

Land situated within the jurisdiction of New Town Development Authority; or

Any land allocated for residential, commercial, industrial or any other non-agricultural use as proposed in the draft/final Regional plan or Town Planning Scheme prepared under the Maharashtra Regional and Town Planning Act, 1966.

In short, a non-agriculturist can now acquire agricultural land for non-agricultural purpose (residential/commercial/industrial), if such land falls under any of the five exceptions to Section 63 of the MTAL as mentioned above.

THE MAHARASHTRA LAND REVENUE CODE. 1966 42.Permission for non-agricultural use. No land used for agriculture shall be used for any non-agricultural purpose; and no land assessed for one non-agricultural purpose shall be used for any other non-agricultural purpose or for the same non-agricultural purpose but in relaxation of any of the conditions imposed at the time of the grant or permission for non-agricultural purpose, except with the permission of the Collector. 44.Procedure for conversion of use of land from one purpose to another. (1)If an occupant of unalienated land or a superior holder of alienated land or a tenant of such land-- (a)which is assessed or held for the purpose of agriculture, wishes to use it for a non-agricultural purpose, or (b)if land is assessed or held for a particular non-agricultural purpose, wishes to use it for another non-agricultural purpose, or (c)desires to use it for the same non-agricultural purpose for which it is assessed but in relaxation of any of the conditions imposed at the time of grant of land or permission for such nonagricultural purpose, such occupant or superior holder or tenant shall, with the consent of the tenant, or as the case may be, of the occupant or superior holder, apply to the Collector for permission in accordance with the form prescribed.

In Maharashtra, only an agriculturist can purchase agricultural land and if a person holds such land anywhere else in India, he can still be deemed an agriculturist in Maharashtra. The maximum ceiling limit for such land is 54 acres.

Do you have agricultural land anywhere in India in your name or do you belong to an agricultural family?

If so you can buy.

  1. As per the information mentioned in the present query, makes it clear that you want to buy an agricultural land and then want to use the same for industrial purpose.
  2. Though you do not have any background of having a farmer family, but still you can get the land if you can get the certificate from the Tehsildar of the district.
  3. And for getting the certificate you will have to ensure that the land will only be used for the agricultural purpose.
  4. Then later on, if the law permit in the same area to carry out industrial activity then you can go for and seek the conversion of the use of land.
