• Land survey number placed somewhere else in village

My grand parents bought land of 2 acre and 19 guntas in village at year 1920 at that time land registration copy showing survey no 99 having 11 acre and 31 guntas, in bitween our family moved to another place and they did not sold to anybody, now we got copy of land record and checked at taluk office now its showing only 10 guntas for survey no 99 in record. i go through the document which we have and i noticed in between 1920 to now land re survey has done. and survey number has been moved to another place. i got both of the village map (old survey and new re survy) and conformed about that. is any chance to get our land..?

Dear Sir,

You can get it, if you take the issue seriously. You have make application to the Survey Department. Approach the Revenue Authorities and also file suit and writ petition.

See you can get you land if there is no illegal possession over same that is adverse possession , you can check new survey number from the map of your old survey number and can seek demarcation of land from the revenue authority.

you have to file civil suit. seek appointment of advocate commissioner and also authorised surveyor for measuring the land and for correct the survyey number contact local property lawyer.

You should file a RTI application in revenue office to get details of survey no. 99 of 1920 for land measuring 11 acres and 31 guntas along with application attach the copy of registry which you have.

First you go to the village and approach the village revenue officer, ascertain the details including the survey numbers of the property from that date till this date.

The survey numbers will be changed over a period of time.

You may also verify the property details from the village revenue records and confirm its availability in the same place by physically visiting the place where your land is situated and then plan legal action if you dont find your land or the extent of land that was originally bought by your grandfather in the year 1920.

  1. As per the information mentioned in the present query, makes it clear that the problem has arisen due to non-presence of any one of yours family for such a long time.
  2. As you said the survey number has changed and you have got the record showing your Male position and new survey number, you should give a representation to the SDM of your district to correct the position of your land in accordance of the new survey number.
  3. If they do not give positive reply then you should approach the Hon’ble High Court Inder Writ Jurisdiction of Mandamus in nature under Article 226 of our Constitution seeking immediate intervention in the matter and directions to the respondent therein for doing the needful.
