• Indian couple wants to adopt an adult lady foreigner

A well settled Indian couple, both in their sixties, wish to adopt a girl, aged 35 , who's a citizen of Latvia. She's here in India, on X visa for 5 years.
The Indian couple loves this Latvian girl, since both have the same religious faith. They would like to live together for the rest of their lives, in India, without any visa issues.

Is it possible to do this?

You cannot adopt adult lady of 35 years of age unless there is custom in your community to that effect 

 

under section 10 of Hindu adoption and maintenance act you cannot child more than 15 years of age

Person of 35 years cannot be adopted. Max of minor up to 18 year can be adopted. Apply for long term visa and after certain period, she will be entitle to Indian citizenship. And for inheritance rights to her, can execute WILL.

Yes you can adopt the lady but for that you have to contact her parents  execute an adoption deed with you and also have to contact the govt of country she comes from or embassy of that country to get the permission for her adoption.

Sir under all applicable Indian laws child above 15 can be only adopted when there are such custom and usage otherwise with deed also adoption is not valid. FOr adoption the applicable law is Hindi adoption and maintenance act, you can also refer the CARA guidelines.

Section 10(iv) in The Hindu Adoptions and Maintenance Act, 1956

(iv) he or she has not completed the age of fifteen years, unless there is a custom or usage applicable to the parties which permits persons who have completed the age of fifteen years being taken in adoption.

 

 Hence adult foreigner cannot be taken in adoption unless there is custom in your community to that effect
