Indian couple wants to adopt an adult lady foreigner
A well settled Indian couple, both in their sixties, wish to adopt a girl, aged 35 , who's a citizen of Latvia. She's here in India, on X visa for 5 years. The Indian couple loves this Latvian girl, since both have the same religious faith. They would like to live together for the rest of their lives, in India, without any visa issues. Is it possible to do this? Can any family lawyer help us with this?

Person of 35 years cannot be adopted. Max of minor up to 18 year can be adopted. Apply for long term visa and after certain period, she will be entitle to Indian citizenship. And for inheritance rights to her, can execute WILL.
Adoption of girl of 35 years of age is not possible. She can apply for long term visa.

Yes you can adopt the lady but for that you have to contact her parents execute an adoption deed with you and also have to contact the govt of country she comes from or embassy of that country to get the permission for her adoption.
Most lawyers responded that adult adoption is not allowed. But some lawyers said it is. Can you please provide the reference to the adoption law in India - which section of the law book, allows for the adoption of an adult foreigner? We received some recommendations that by executing a deed with the adult girls parents and after getting permission from her embassy, it is possible to adopt an adult foreigner. Indian law is restricted on this, can check if latvia adoption law provides some relief.
Sir under all applicable Indian laws child above 15 can be only adopted when there are such custom and usage otherwise with deed also adoption is not valid. FOr adoption the applicable law is Hindi adoption and maintenance act, you can also refer the CARA guidelines.
Section 10(iv) in The Hindu Adoptions and Maintenance Act, 1956
(iv) he or she has not completed the age of fifteen years, unless there is a custom or usage applicable to the parties which permits persons who have completed the age of fifteen years being taken in adoption.
Hence adult foreigner cannot be taken in adoption unless there is custom in your community to that effect
You were clearly opined that there is no provision i law for adopting adult in India.
UIf you still insist on any misguidance, you may better contact the same lawyer by personal contacts taking their phone numbers from this forum and follow the instructions that has been passed by them, but before that be sure that there is any provision for this.
The adopted child should not be less than 20 years younger.
