• Pay protection under Maharashtra civil service rule

I am working as Senior research assistant at MPKV,Rahuri in pay band [deleted] in grade pay 4600 today in 6th pay commission. Today my basic salary is 22190+4600. I was appointed as a Assistant professor at PDKV,Akola in pay scale 15600+gp 6000. I am going to join on 20/6/2019. whether my pay will be protected and will they fix on 22190+4600 or whether i will get benefit of old pay while fixing it in new pay.

Yes, pay shall be protected after submission of LPC , benefit of the grade shall only be given if at the time of fixing the pay earlier has been exhausted.

If at the stage of Rs.22190/- previous grade is exhausted at the time of fixing the pay or protection of pay then new grade having higher slabs has to be given to the employee.

If you had quit the previous employment under technical resignation through proper channel, then your pay may be protected provided the same is recognised by the new employer.

For the fixation of pay under the new employment, you may first clarify from the office of the new employer, in case of any discrimination in the pay fixation, you may better make a representation in writing to the top management about this before approaching the legal forum for relief after which you can initite legal actions for proper relief and remedy.
