How can we use CCTV footage as an evidence to present in court, is there any Affidavit required to present it in court, if so please provide format of the same.

A CCTV footage is recorded on  a CD and presented by an affidavit stating the contents and vouching for its authenticity under s 65b.

Yes the footage is admissible in the court you can give same in court along with section 65-B certificate.

3)mention that cameras installed in premises includes   the   device   known   as   Network   Video   Recorder
comprising hard­disc, LCD screen monitor and router with cameras in
all eight in number.  You have to state that the capacity of the memory
of the hard­disc was ———GB and it was of Company make.
There were provisions in the CCTV cameras for automatic recording
of events of 24 hours. You have to state that the CCTV cameras will record
the movements for about 20 days approximately and used to operate
for 24 hours.  He further states that on continuous recording for about
20 days and on finishing the space in the memory of hard­disc, there
was a system to delete the earlier recording carried on the very first
day and to capture the current movements occurring at that time

For presenting the electronic evidence in court a certificate of Section 65 B of evidence act is required for certification of evidence.

In this case footage of CCTV camera is electronic evidence.

This is to certify that I am __________ and reside/work at____________. I am owner/ incharge/user of the DVR installed at (location)  , the  description of the DVR is  as follows:-

  • Electronic record  : Description of the document to be proved ( CCTV footage)
  • DVR :  Make-

Serial Number-

Software-             Compression software(if any)-

I certify the aforesaid Video Footage(name of the video file) generated from the above DVR that:

  1. The recordings contained in the above DVR were generated into it in the ordinary course of activity/usage of the DVR which was into my possession/control.
  2. During the period ____ to _____ the above mentioned DVR was operating properly and there have been no such operational problems so as to affect the accuracy of the electronic record.
  3. During this period, the DVR was in my possession and safe custody and the its software’s have built in security mechanisms i.e. Password Protected Access Control etc.
  4. The electronic record generated from the above DVR has been derived from the information fed into it and is a true extract of the data in the aforesaid mobile.
  5. The above said mobile is in working conditions, till today i.e. ___________ when the output was taken from the aforesaid DVR. The data transferred on CD/DVD/Pen Drive has been taken directly from the DVR by connecting it with the computer system through data cable.
  6. I am personally involved into the coping the data on CD/DVD/Pen Drive and / or  have been done  by technical expert —————  in my presence .
  7. I am computer literate and having _________________ qualification (s) in IT.
