• What is the hurdle for the Government to NOT to convert B khata properties to A khata?

Respected Experts,

I believe the B khata issue is pending since atleast a decade or even more in Karnataka. There could be very few properties which are genuinely an issue , but I guess more than 70-80% ( just a guess ) of the properties ( both plots and Apartments ) does not really qualify for B Khata... but why the government is taking no actions on them to convert to A Khata? Infact converting B khata to A Khata will fetch more income for the government in terms of Betterment charges. Whats the actual hurdle for the Government ? Could you help me to know this ?

A plan is underway in Karnataka to regularise over one lakh B-Khata properties within corporation limits. Soon, owners of B-Khata properties in the state can obtain an A-Khata by paying an improvement and conversion charges.

Dear Client,

BBMP has cleared the decks for conversion of all B-Khata sites to A-Khata sitee, owners who want to convert their sites will have to pay betterment and improvement tax to BBMP, and clear procedures under Akrama-Sakrama. This is usual approach of govt, sluggish, sometimes takes years to implement the scheme, entire procedure of conversion to A Khatha may take time. Another reason fro dealy, property owners have to clear many procedures.

What is a khata?

A Khata is essentially a revenue document, detailing the assessment of a property, recording details about the property such as size, location, built up area and so on for the purpose of payment of property tax.

It is also a kind of identification of the person who is primarily liable for payment of property tax. It is one of the required documents in case you require a building licence, trade licence or loan from banks or any other financial institutions.

What is the difference between an A Khata and B Khata?

What any property buyer should know while buying property in Bangalore is that it should have A khata.

An A khata means you are buying a property that is legal, and it will allow you to construct on it and obtain a trade or building license.  Here are some further details on the difference between A Khata and B Khata.

Then how did the term B Khata come into being?

Well in 2007 when BBMP came into being 2 things were apparent:

1) There were many properties that fell under its jurisdiction that were illegal constructions
2) There was a need for an uniform taxation policy

Regarding the former the BBMP found that these illegal constructions were enjoying civic amenities without paying taxes. While regarding the latter, there was a need to consolidate the tax collection process to make it simpler which was earlier collected by 3 different bodies.

Now, the newly formed BBMP had the power to levy taxes on the aforementioned illegal constructions. The taxes collected from these properties were recorded in a register known in common parlance as B register and the khata issued therein was known as a B khata.

Thus anyone having a B khatha essentially is a non BBMP approved construction. Hence it is not advisable to buy such properties.

However, it is only fair to mention that any B khata property can be converted into an A khata property.

1. Conversion of Khata's involve huge Survey & Change in records of different departments. Further various revenue loss to the Govt. for such permanent conversion also has to be considered. There would be permanent loss of Land title, for some encroached & constructed properties.  Title /Possession disputes between present and past Khata holders and related pending litigation are also a bane.

All these things take considerable time. Atleast the Govt. is trying and may benefit such Khata holders.

It is the political will as well as many irregularities which are faced by the best khata property which cannot be easily conveted to A khata property easily

There is no such process. It is in the hands of BBMP/BDA. They may cosider in near future..

B Khata is a temporary document while A Khata is the permanent one. A Khata Property Tax and B Khata Property Tax are levied on the residents of Bangalore and fall under the jurisdiction of the Bruhat Bengaluru Mahanagara Palike (BBMP), which is Bangalores municipal corporation.

There are practical difficulties for converting B khata to A khata.

A plan is underway in Karnataka to regularise over one lakh B-Khata properties within corporation limits. Soon, owners of B-Khata properties in the state can obtain an A-Khata by paying an improvement and conversion charges.

Earlier, the BBMP had said that B-Khata properties could be regularised under the Akrama-Sakrama scheme. However, with this scheme being heard in the Supreme Court, the BBMP Commissioner, N Manjunath Prasad has clarified that B Khata can be delinked from Akrama-Sakrama.

Now that the B-Khata is set to be regularised, necessary changes and amendments need to be done in the Karnataka Land Revenue Act 1964.

In January this year, the state government informed the High Court that BBMP was taking steps to make the khata transfer as seamless and transparent as possible. This would include a uniform policy on applications for khata entries that would be maintained under BBMP Property Tax Rules, 2009. The possibility of inviting online applications was also being looked into.
