• Hyderabad petty case 70a

Hi 
there was a scuffle in office and the other person went to the police station to complain. The police called me and I went to the police station. The police said there is no evidence but they will have to register a petty case under 70a. they took my photo and adhaar number etc and said I have to go to court and only a small fine will be required.
Is this true? How can they register a case without any evidence that I started it? and will it be just a fine? do I need an advocate?

70: Indecent acts in street etc. Whoever in any street or public place or place of public resort (a) is in such a state of intoxication as not to be able to protect himself, (b) behaves in an indecent, riotous disorderly manner, (c) uses any threatening, insulting or obscene words or gestures, likely to disturb public peace or cause public nuisance, shall be punished with imprisonment for a term which may extend to eight days or with fine which may extend to fifty rupees. 

 

2) you have been charged under provisions of section 70 of Hyderabad police act for behaving in an indecent disorderly manner 

 

3) only nominal fine would be imposed 

 

4) you don’t need an advocate

Sir imposition of 70a is for causing public nuisance and  disturbing public peace there would be fine for same you can engage advocate for help and formalities though as such not required you just need to deposits the small amount as penalty.

From your inputs here, it seems that they are registering cases under nuisance etc. and you need to pay fine for that. You are suggested to approach and appear in court as and when required and get rid of the issues.

Dear sir 

You have mention case of  70 A but of Which Act they are registering the case. ???

And you don't have to worry as the case can be of 107/151 CrPC for maintaining peace in situations and giving bail bond regarding this in from of SDM and you will be needing an Advocate for the purpose. Of paying fine and bail bonds etc.

The FIR is registered on the basis of the complaint of the other party and if police has taken this complaint and register the FIR then you need not to worry about and wait for the notice to come when you receive the notice then appear before the court and pay the penalty as imposed by the court it will be very small penalty

70a under which act. You must be booked under local law.

Some petty offenses are provided in law for which minute penalty is paid in court if admitted guilty. But than this will always show in your back ground check/police verification. So, when police ask you to appear in court, hire lawyer and contest it instead of admitting guilt. Penalty will be around 100rs but not good for back ground check like police verification for VISA, job, passport etc.
