Dear Sir,

If a GPA is registered and duly stamped, the GPA holder has the power to execute the sale deed. Any registered property owner can execute a GPA in favour of their spouse, son, daughter, brother, sister or any other relative to manage his property or empower him to execute any further deed of transfer including conveyance, sale and gift deed.

In case you want to check the authenticity of the GPA, you can check for the encumbrance certificate (EC). If you find the entry of GPA registration, it means that there is a registered Power of Attorney and the GPA holder is not executing on his behalf, but on behalf of the builder and hence, in all legal aspects the sale is between you and the builder. In other words, the builder is the seller and you are the purchaser. Thus, the sale will be considered as valid.

You can enter into sale agreement with GPA holder and get the the sale agreement registered and after that as per your convenience and the conditions laid down in the sale agreement you can get the property registered and take the position of the property and pay the consideration accordingly

What is your query.

The actions to be done through the GPA is to be guided by the agreement you may have with the GPA holder.

If there is no specific agreement with regard thereto then unless anything is mentioned in the GPA it would be a uphill task to get your money back.
