I have bought a flat. All khatian nos are ok in my own deed and seller's deed but in endorsement sheet of seller, one khatian no is typed wrong but it is correct in my endorsement sheet i.e. major deed information. In my deed it is also mentioned that in seller's endorsement sheet inadvertently a mistake of khatian no has been taken place and it should be of this value. My endorsement sheet holds all the correct khatian information. What steps I should follow now to be safe in future?

Dear Sir,

The mistakes may be of various types. For example, the area of the property, its dimensions, location or the survey number may be wrong. These may be typographical errors or because of improper comparison with the property documents like the transfer deed, sale deed, title deed, revenue records etc. 

These errors can be rectified through the execution of a supplementary document called rectification deed. Rectification deed is a document executed between parties to correct a mistake in the principal deed. 
There must have been a bonafide mistake where the original deed does not reflect the true intention of parties to the deed. The mistake should pertain to facts only. It should not be a mistake of law.

This is a minor mistake though it is better to correct it.

So to correct it you need to make a deed of rectification and make it registered as well.

So get in touch with the all the parties and execute and register such deed asap.

your sale deed mentions correct survey nos 

 

2) in your endorsement sheet also correct survey number is mentioned 

 

3) if there is mistake in endorsement sheet of seller ask him to get it rectified

Details should be correct in sale deed. If correction wants that it will done in seller`s deed. Your fresh deed is OK and mistake in seller deed clarified in your deed, so no issue. Make sure map attach to seller deed, khatian no. should be correct in that.

You have to file a correction suit in the Civil Court and get the order of the magistrate in this regard after that the registrar will rectify the mistake

1. Your registered sale deed  has already mentioned tha error committed in the endorsement sheet of the seller.

 

2. The ideal step would have been for the seller to get the endorcement sheet corrected which is not possible now.

 

3. You are not expected to face any problem for the said error now.

You can  make  a  rectification of  the erroneous  entry  in  the seller's endorsement sheet and  get  it  duly signed  by  the  competent  authority.

If  the rectification  is  not of  much  importance then  you may  ignore it, however you may produce  the papers before  a local advocate  and  get it clarified.
