• Buy a land

I am planning to buy a land which is purchased 40 years back by a land owner, we have checked the EC, there is no encumbrance, the land is registered with the same name which is there in the copy of the orginal land document, the land documents contains only the name and the old address, now they are not living in the same place, Now how to verify land owner details with this only copy of the land document. Brokers are not providing their contact details also, Is that fine i can verify these all the details on registration date. please let me know.

IF broker is now providing detail of seller, avoid the deal. Find some local lawyer who will prepare search report from sub registrar office.

Ask seller to produce original title deeds for inspection 

 

2) further insist on

per meeting with the seller . Enter into agreement for sale and only if title is clear and marketable enter into sale deed 

 

3) check whether property taxes have been paid tilldate

Need not to go for any address verification. Ensure the person selling the land and signing the deed are the same person as appearing in the existing registered deed. You can ask for any Id proof of your seller.  If the property is passed on to the legal heirs ask for legal heir certificates. Always ask for ID proof and address proof of seller. The person need to come to sign deed when you can verify his identity.

As the sale deed is 40 years old, it will not contain the signature of the buyer, who now is the seller. The sale deed must have been a deed poll, executed only by the seller thereof. Besides the father's name and age, there would not have been anything to establish the buyer's identity, and certainly there would not have been a photograph. It is better to contact the seller before you pay the sale consideration and sign the sale deed, and satisfy yourself about his identify beyond any doubt.

See before registration you should go for search report and further I would advise you to apply for bank loan even if you are capable to pay the bank shall search throughly.

Also ask for chain documents from the said person.
