• Buying land not approved by BIAPPA in Sadahalli Bangalore

I am planning to buy a piece of land in North Bangalore in a place called Sadahalli. The layout which is a gated community was formed in 1991, about 5 years before BIAPPA was formed. The layout is DC converted and has all proper titles and documents. Untill 2016, BIAPPA was issuing approvals for building plans. However, they have stopped since a government order was passed in 2016 that prevents them from giving approval to layouts not approved by them. So now the panchayat is giving approval for the building plan. Is there any risk in buying this property?

layouts approved by the gram panchayats can be modified, altered or rejected by the government
through municipality or corporation.
so it is better to verify all the documents and permissions before purchasing, contact a local property lawyer.

If the area is under panchayat then there is no issue if panchayat approves the plans it is perfect you can purchase the property

If they are not the legal authority to give approval then there is no harm. But if they are statutory authority then their Approval is needed.

go to BIAPPA office and check with the approval number and cross check with the survey number shown in the approved layout plan,construction Can be made if the building plan is sanctioned by the Gram Panchayat.

The panchayat cannot give approvals even if the BIAAPA has stopped issuing the approvals.

The approvals given by panchayat is not legally valid, hence the approval from the competent authority namely BBMP or any other authority is essential.

You may take a legal opinion from a local lawyer and then proceed.

Since the layout approval has already been issued by BIAAPA, it cannot be revoked now for any reason.

However you may clarify about the gram panchayat approvals because they are no more authorised to sanction approvals.

  1. As per the information mentioned in the present query, makes it clear you can get the approval but from the panchayat not authority.
  2. The authority is the land owing agency who can only give the approval, who knows under which notification of delegates authority the main authority has given the right for giving approval plan to the people.
  3. I would advice you to please mark a RTI seeking exact answer as to under provision panchayat has been directed to give the approval and if no then the authority should give one reply that they would not have any issue with the approval later in the future.
